1 1 Section 1. Section 88.16, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. The commissioner shall conduct
1 4 directly, or by contract, a mandatory course of instruction
1 5 for occupational safety and health inspectors, designed to
1 6 sensitize those inspectors to the strengths, circumstances,
1 7 priorities, concerns, abilities, and capabilities of Iowa's
1 8 business community, with the goal of improving the attitudes
1 9 of the inspectors and their conduct toward employers through
1 10 the development and use of communication and negotiation
1 11 skills. The course shall include examples of successful
1 12 methods for combining necessary enforcement with partnerships
1 13 that protect employees while lowering workers' compensation
1 14 costs for employers, describe compliance assistance, and
1 15 inform inspectors of the federal occupational safety and
1 16 health administration's broad range of cooperative
1 17 partnerships between employers, workers, and government. The
1 18 commissioner shall develop a program of designed, basic
1 19 experiences that include both observation and participation in
1 20 nonthreatening inspection activities and shall develop in
1 21 inspectors an understanding of the role of the employer and an
1 22 understanding of the philosophical and sociological
1 23 foundations underlying the development and organization of
1 24 free market competition in the United States.
1 25 EXPLANATION
1 26 This bill requires the commissioner of labor to conduct
1 27 directly, or by contract, a mandatory course of instruction
1 28 for occupational safety and health inspectors. The course
1 29 shall be designed to sensitize inspectors to the role of
1 30 Iowa's business community, with the goal of improving the
1 31 attitudes of the inspectors and their conduct toward employers
1 32 through the development and use of communication and
1 33 negotiation skills.
