PAG LIN 1 1 Section 1. Section 476.42, subsection 2, Code 1999, is 1 2 amended to read as follows: 1 3 2. "Electric utility" means, except as provided in section 1 4 476.47, a public utility that furnishes electricity to the 1 5 public for compensation. 1 6 Sec. 2. NEW SECTION. 476.47 NET ENERGY MEASUREMENT AND 1 7 METERING. 1 8 1. As used in this section, unless the context otherwise 1 9 requires: 1 10 a. "Avoided cost" means the cost the utility would have to 1 11 pay to provide energy and capacity from alternative sources of 1 12 supply available to utilities as calculated pursuant to 1 13 formulas determined by the board by rule. 1 14 b. "Customer-generator" means a user of a net metering 1 15 system. 1 16 c. "Electric utility" means an electric utility required 1 17 to be rate-regulated under this chapter. 1 18 d. "Net metering" means measuring the difference in an 1 19 applicable billing period between the electricity supplied by 1 20 an electric utility and the electricity generated by a 1 21 customer-generator which is fed back to the electric utility. 1 22 e. "Net metering system" means a facility for the 1 23 production of electrical energy that does all of the 1 24 following: 1 25 (1) Uses as its fuel either solar, wind, biomass, or 1 26 hydropower. 1 27 (2) Is located on a customer-generator's premises. 1 28 (3) Operates in parallel with the electric utility's 1 29 transmission and distribution facilities. 1 30 (4) Is intended primarily to offset part or all of the 1 31 customer-generator's requirements for electricity. 1 32 2. a. An electric utility shall offer to make available 1 33 an energy meter that is capable of registering the flow of 1 34 electricity in two directions to each eligible customer- 1 35 generator that has installed a net metering system. 2 1 b. An electric utility may, at its own expense and with 2 2 the written consent of the customer-generator, install one or 2 3 more additional meters to monitor the flow of electricity in 2 4 each direction. 2 5 c. An electric utility shall not charge a customer- 2 6 generator any fee or charge that would increase the customer- 2 7 generator's minimum monthly charge to an amount greater than 2 8 that of other customers of the electric utility in the same 2 9 rate class as the customer-generator. 2 10 3. Consistent with the other provisions of this section, 2 11 the measurement of net electricity supplied or generated shall 2 12 be calculated in the following manner: 2 13 a. The electric utility shall measure the net electricity 2 14 produced or consumed during the billing period, in accordance 2 15 with normal metering practices. 2 16 b. If the electricity supplied by the electric utility 2 17 exceeds the electricity generated by the customer-generator 2 18 and fed back to the electric utility during the billing 2 19 period, the customer-generator shall be billed for the net 2 20 electricity supplied by the electric utility, in accordance 2 21 with normal metering practices. 2 22 c. If electricity generated by the customer-generator 2 23 exceeds the electricity supplied by the electric utility, the 2 24 customer-generator shall be billed for the appropriate 2 25 customer charges for that month and shall be credited for the 2 26 excess kilowatt-hours generated during the month, with the 2 27 kilowatt-hour credit appearing on the customer-generated 2 28 electricity billing for the following month. At the end of 2 29 the calendar year, the electric utility shall pay the 2 30 customer-generator for any remaining unused credit for excess 2 31 kilowatt-hours generated during that calendar year. Payment 2 32 for this credit shall be at the utility's avoided cost. 2 33 4. A net metering system used by a customer-generator 2 34 shall meet all applicable safety and performance standards 2 35 established by the national electrical code, the institute of 3 1 electrical and electronics engineers, and underwriters 3 2 laboratories. 3 3 5. The board shall adopt rules pursuant to chapter 17A 3 4 relating to additional control and testing requirements for 3 5 customer-generators that the board determines are necessary to 3 6 protect public and worker safety and system reliability. 3 7 6. An electric utility shall not require a customer- 3 8 generator whose net metering system meets the standards 3 9 provided for in subsections 4 and 5 to do any of the 3 10 following: 3 11 a. Comply with additional safety or performance standards. 3 12 b. Perform or pay for additional tests. 3 13 c. Purchase additional liability insurance. 3 14 Sec. 3. This Act is not applicable for the duration of any 3 15 agreement between an electric utility and a customer-generator 3 16 relating to the use of a net metering system if the agreement 3 17 is in effect on the effective date of this Act. 3 18 Sec. 4. EFFECTIVE DATE. This Act, being deemed of 3 19 immediate importance, takes effect upon enactment. 3 20 EXPLANATION 3 21 This bill provides for the use of a net metering system by 3 22 a facility for the production of electrical energy which uses 3 23 as its fuel either solar, wind, biomass, or hydropower. The 3 24 facility must be located on the customer-generator's premises 3 25 and the system must operate in parallel with the electric 3 26 utility's transmission and distribution facilities. The 3 27 system must be intended to primarily offset part or all of the 3 28 customer-generator's requirements for electricity. 3 29 The bill provides that an electric utility shall offer to 3 30 make available an energy meter that is capable of registering 3 31 the flow of electricity in two directions to each eligible 3 32 customer-generator's net metering system. An electric utility 3 33 may, at its own expense and with written consent, install one 3 34 or more additional meters to monitor the flow of electricity 3 35 in each direction. An electric utility shall not charge a 4 1 customer-generator any fee or charge that would increase the 4 2 customer-generator's minimum monthly charge to an amount 4 3 greater than that of other customers of the electric utility 4 4 in the same rate class as the customer-generator. 4 5 The bill provides for the method of net energy measurement 4 6 and billing. At the end of a calendar year, an electric 4 7 utility shall pay a customer-generator for any remaining 4 8 unused credit for excess kilowatt-hours generated by the 4 9 customer-generator during that calendar year. 4 10 The bill provides that any agreement existing on the 4 11 effective date of the bill between an electric utility and a 4 12 customer-generator and relating to the use of a net metering 4 13 system shall remain in effect for the term of the agreement. 4 14 The bill takes effect upon enactment. 4 15 LSB 1237DP 78 4 16 tm/gg/8
