  1  1    Section 1.  Section 453A.13, subsection 2, Code 1999, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  c.  The department, or a city or county,
  1  4 shall submit a duplicate of any retail permit issued by the
  1  5 entity under this subsection to the Iowa department of public
  1  6 health within thirty days of the issuance.
  1  7    Sec. 2.  Section 453A.13, subsection 3, Code 1999, is
  1  8 amended to read as follows:
  1  9    3.  FEES – EXPIRATION.
  1 10    a.  All permits provided for in this division shall expire
  1 11 on June 30 of each year.  A permit shall not be granted or
  1 12 issued until the applicant has paid for the period ending June
  1 13 30 next, to the department or the city or county granting the
  1 14 permit, the fees provided for in this division.  The annual
  1 15 state permit fee for a distributor, cigarette vendor, and
  1 16 wholesaler is one hundred dollars when the permit is granted
  1 17 during the months of July, August, or September.  However,
  1 18 whenever a state permit holder operates more than one place of
  1 19 business, a duplicate state permit shall be issued for each
  1 20 additional place of business on payment of five dollars for
  1 21 each duplicate state permit, but refunds as provided in this
  1 22 division do not apply to any duplicate permit issued.
  1 23    b.  The fee for retail permits is as follows when the
  1 24 permit is granted during the months of July, August, or
  1 25 September:
  1 26    a. (1)  In places outside any city, fifty one hundred
  1 27 dollars.
  1 28    b. (2)  In cities of less than fifteen thousand population,
  1 29 seventy-five one hundred fifty dollars.
  1 30    c. (3)  In cities of fifteen thousand or more population,
  1 31 one two hundred dollars.
  1 32    c.  If any permit is granted during the months of October,
  1 33 November, or December, the fee shall be three-fourths of the
  1 34 above maximum schedule; if granted during the months of
  1 35 January, February, or March, one-half of the maximum schedule,
  2  1 and if granted during the months of April, May, or June, one-
  2  2 fourth of the maximum schedule.
  2  3    d.  Cities and counties shall use any revenues generated
  2  4 from the retail permit fees, which are in excess of the
  2  5 administrative costs associated with the issuance of permits
  2  6 and reporting under subsection 2, paragraph "c", for the
  2  7 exclusive purpose of enforcing chapter 142B, section 453A.2,
  2  8 section 453A.36, subsection 6, section 453A.36A, and section
  2  9 453A.39.
  2 10    Sec. 3.  Section 453A.22, Code 1999, is amended by adding
  2 11 the following new subsection:
  2 12    NEW SUBSECTION.  4.  The department or local authority
  2 13 shall report any suspension or revocation of a retail permit
  2 14 under this section to the Iowa department of public health
  2 15 within thirty days of the suspension or revocation.  
  2 16                           EXPLANATION 
  2 17    This bill makes changes in the law relating to retail
  2 18 permits for retail sales of cigarettes.  The bill establishes
  2 19 a statewide repository for retail permit issuance, suspension,
  2 20 and revocation by requiring the entity (city, county, or
  2 21 department of revenue and finance) which issues, suspends, or
  2 22 revokes the permit to submit a duplicate of the activity to
  2 23 the Iowa department of public health within 30 days of the
  2 24 action.
  2 25    The bill also increases retail permit fees.  For places
  2 26 outside the city, the fee is increased from $50 to $100.  For
  2 27 cities of less than 15,000 persons, the fee is increased from
  2 28 $75 to $150.  For cities of 15,000 or more persons, the fee is
  2 29 increased from $100 to $200.  Fees generated in excess of
  2 30 administrative costs are to be used to enforce the clean
  2 31 indoor air Act (Code chapter 142B), youth access restrictions
  2 32 (Code section 453A.2), vending machine limitations (Code
  2 33 section 453A.36), the prohibition of self-service sales (Code
  2 34 section 453A.36A), and the restriction on samples and
  2 35 promotions (Code section 453A.39).
