  1  2                REBUILD IOWA INFRASTRUCTURE FUND
  1  3                    DEPARTMENT FOR THE BLIND
  1  4    Section 1.  There is appropriated from the rebuild Iowa
  1  5 infrastructure fund to the department for the blind for the
  1  6 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  1  7 the following amount, or so much thereof as is necessary, to
  1  8 be used for the purpose designated:
  1  9    For improvements to the facility for the blind:  
  1 10 .................................................. $    122,000
  1 11                    DEPARTMENT OF CORRECTIONS
  1 12    Sec. 2.  There is appropriated from the rebuild Iowa
  1 13 infrastructure fund to the department of corrections for the
  1 14 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  1 15 the following amounts, or so much thereof as is necessary, to
  1 16 be used for the purposes designated:
  1 17    1.  To supplement funds appropriated in 1998 Iowa Acts,
  1 18 chapter 1219, section 2, subsection 3, for construction of a
  1 19 200-bed facility at the Iowa state penitentiary at Fort
  1 20 Madison:  
  1 21 .................................................. $  3,000,000 
  1 22    2.  For community-based corrections projects in Council
  1 23 Bluffs:  
  1 24 .................................................. $    300,000
  1 25                 DEPARTMENT OF CULTURAL AFFAIRS
  1 26    Sec. 3.  There is appropriated from the rebuild Iowa
  1 27 infrastructure fund to the department of cultural affairs for
  1 28 the fiscal year beginning July 1, 2000, and ending June 30,
  1 29 2001, the following amount, or so much thereof as is
  1 30 necessary, to be used for the purpose designated:
  1 31    For historical site preservation grants, to be used for the
  1 32 restoration, preservation, and development of historical
  1 33 sites:  
  1 34 .................................................. $  2,500,000
  1 35    Historical site preservation grants shall only be awarded
  2  1 for projects which meet the definition of "vertical
  2  2 infrastructure" in section 8.57, subsection 5, paragraph "c".
  2  3    In making grants pursuant to this section, the department
  2  4 shall consider the existence and amount of other funds
  2  5 available to an applicant for the designated project.  Each
  2  6 grant awarded from moneys appropriated in this section shall
  2  7 not exceed $100,000 per project.  Not more than two grants may
  2  8 be awarded in each county.  
  2  9               DEPARTMENT OF ECONOMIC DEVELOPMENT
  2 10    Sec. 4.  There is appropriated from the rebuild Iowa
  2 11 infrastructure fund to the department of economic development
  2 12 for the fiscal year beginning July 1, 2000, and ending June
  2 13 30, 2001, the following amounts, or so much thereof as is
  2 14 necessary, to be used for the purposes designated:
  2 15    1.  To be deposited in the physical infrastructure
  2 16 assistance fund created in section 15E.175:  
  2 17 .................................................. $  2,500,000
  2 18    The department shall maximize the moneys appropriated in
  2 19 this subsection, to the extent possible, for physical
  2 20 infrastructure assistance program projects which meet the
  2 21 definition of "vertical infrastructure" in section 8.57,
  2 22 subsection 5, paragraph "c", or for projects which facilitate
  2 23 the creation of "vertical infrastructure" projects.  The
  2 24 department shall report to the general assembly by June 30 of
  2 25 each fiscal year for which funds are appropriated in this
  2 26 subsection regarding the amount of such funds used for
  2 27 "vertical infrastructure" projects and the amount of such
  2 28 funds used for projects which facilitate the creation of
  2 29 "vertical infrastructure".
  2 30    2.  For accelerated career education program capital
  2 31 projects at community colleges which are authorized under
  2 32 chapter 260G and which meet the definition of "vertical
  2 33 infrastructure" in section 8.57, subsection 5, paragraph "c":  
  2 34 .................................................. $  3,000,000
  2 35    The moneys appropriated in this subsection shall be
  3  1 allocated equally among the community colleges in the state.
  3  2 If any portion of the equal allocation to a community college
  3  3 is not obligated or encumbered by April 1, 2001, the
  3  4 unobligated and unencumbered portions shall be available for
  3  5 use by other community colleges.
  3  6    3.  For deposit in the rural enterprise fund to be used for
  3  7 the dry fire hydrant and rural water supply education and
  3  8 demonstration project, notwithstanding section 8.57,
  3  9 subsection 5, paragraph "c":  
  3 10 .................................................. $    200,000
  3 11                 DEPARTMENT OF GENERAL SERVICES
  3 12    Sec. 5.  There is appropriated from the rebuild Iowa
  3 13 infrastructure fund to the department of general services for
  3 14 the fiscal year beginning July 1, 2000, and ending June 30,
  3 15 2001, the following amount, or so much thereof as is
  3 16 necessary, to be used for the purpose designated:
  3 17    For capital projects and improvements at Terrace Hill:  
  3 18 .................................................. $  1,200,000
  3 19    Sec. 6.  1999 Iowa Acts, chapter 121, sections 11 and 12,
  3 20 are amended by striking the sections.
  3 21    Sec. 7.  1999 Iowa Acts, chapter 204, section 4, subsection
  3 22 1, is amended to read as follows:
  3 23    1.  For major renovation and major repair needs including
  3 24 health, life, and fire safety, for compliance with the federal
  3 25 Americans With Disabilities Act for state-owned buildings and
  3 26 facilities:  
  3 27 FY 1999-2000 ..................................... $  7,500,000
  3 28 FY 2000-2001 ..................................... $  7,500,000
  3 29    Notwithstanding section 8.57, subsection 5, paragraph "c",
  3 30 of the amount appropriated for each the fiscal year beginning
  3 31 July 1, 1999, in this subsection, up to $800,000 may be used
  3 32 by the department for routine maintenance needs for the
  3 33 capitol complex.
  3 34    The moneys appropriated in this subsection for the fiscal
  3 35 year beginning July 1, 2000, shall be used for the repair or
  4  1 replacement of building components to return state-owned
  4  2 buildings or facilities to their intended uses or to make them
  4  3 compliant with changes in laws, regulations, or codes.  The
  4  4 moneys shall be allocated in accordance with the priorities
  4  5 and recommendations set forth by the vertical infrastructure
  4  6 advisory committee.
  4  7    Sec. 8.  1999 Iowa Acts, chapter 204, section 4, subsection
  4  8 15, is amended by striking the subsection.
  4  9    Sec. 9.  1998 Iowa Acts, chapter 1219, section 6,
  4 10 subsection 1, unnumbered paragraphs 3 and 4, as amended and
  4 11 enacted by 1999 Iowa Acts, chapter 204, section 39, are
  4 12 amended to read as follows:
  4 13    Of the amount appropriated in this subsection, up to
  4 14 $1,250,000 may be used by the department for the purchase,
  4 15 demolition, assessment, and site conditioning of property
  4 16 located at the southwest corner of Lyon street and East Tenth
  4 17 street, together with the contiguous property south of the
  4 18 southwest corner property and the property between East Tenth
  4 19 street and East Eleventh street between Lyon street and Des
  4 20 Moines street, all within the following boundaries:  south of
  4 21 interstate 235, north of Grand avenue, east of Pennsylvania
  4 22 avenue, and west of East Fourteenth street in the city of Des
  4 23 Moines.
  4 24    Of the amount appropriated in this subsection, up to
  4 25 $430,000 may be used by the department to complete the
  4 26 infrastructure assessment, notwithstanding section 8.57,
  4 27 subsection 5, paragraph "c".  
  4 28                         JUDICIAL BRANCH
  4 29    Sec. 10.  There is appropriated from the rebuild Iowa
  4 30 infrastructure fund to the judicial branch for the fiscal year
  4 31 beginning July 1, 2001, and ending June 30, 2002, the
  4 32 following amount, or so much thereof as is necessary, to be
  4 33 used for the purpose designated:
  4 34    For construction of a new judicial building:  
  4 35 .................................................. $  8,300,000
  5  1    The judicial branch is authorized to enter into contracts
  5  2 for the full cost of the planning, design, and construction of
  5  3 a new judicial building for which appropriations are made in
  5  4 this section and in 1998 Iowa Acts, chapter 1223, section 8,
  5  5 and 1999 Iowa Acts, chapter 204, section 6.  The state shall
  5  6 not be obligated for costs associated with contracts
  5  7 identified in this paragraph in excess of funds appropriated
  5  8 by the general assembly.  Notwithstanding any provision of
  5  9 this Act to the contrary or section 8.33, moneys appropriated
  5 10 in this section that remain unencumbered or unobligated at the
  5 11 close of the fiscal year that begins July 1, 2003, shall
  5 12 revert at the close of that fiscal year.  However, if the
  5 13 project for which the moneys are appropriated is completed in
  5 14 an earlier fiscal year, unencumbered or unobligated moneys
  5 15 shall revert at the close of that fiscal year.
  5 16    Sec. 11.  1998 Iowa Acts, chapter 1219, section 8, is
  5 17 amended to read as follows:
  5 18    SEC. 8.  There is appropriated from the rebuild Iowa
  5 19 infrastructure fund to the judicial department for the fiscal
  5 20 year beginning July 1, 1998, and ending June 30, 1999, the
  5 21 following amount, or so much thereof as is necessary, to be
  5 22 used for the purpose designated:
  5 23    For capital projects at the capitol building:  
  5 24 .................................................. $    250,000
  5 25    Notwithstanding section 8.33, unencumbered or unobligated
  5 26 funds remaining on June 30, 2000, 2002, from the funds
  5 27 appropriated in this section shall revert to the rebuild Iowa
  5 28 infrastructure fund on August 31, 2000 2002.
  5 29    Sec. 12.  1998 Iowa Acts, chapter 1223, section 8, is
  5 30 amended to read as follows:
  5 31    SEC. 8.  JUDICIAL DEPARTMENT.  There is appropriated from
  5 32 the rebuild Iowa infrastructure fund to the judicial
  5 33 department for the fiscal year beginning July 1, 1997, and
  5 34 ending June 30, 1998, the following amount, or so much thereof
  5 35 as is necessary, to be used for the purpose designated:
  6  1    For design and development of a new judicial building:  
  6  2 .................................................. $  1,700,000
  6  3    Notwithstanding section 8.33, unencumbered or unobligated
  6  4 funds remaining on June 30, 2000, 2003, from the funds
  6  5 appropriated in this section shall revert to the rebuild Iowa
  6  6 infrastructure fund on August 31, 2000 2003.  
  6  7                   DEPARTMENT OF PUBLIC SAFETY
  6  8    Sec. 13.  There is appropriated from the rebuild Iowa
  6  9 infrastructure fund to the department of public safety for the
  6 10 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  6 11 the following amount, or so much thereof as is necessary, to
  6 12 be used for the purpose designated:
  6 13    For planning, design, and construction of a new building to
  6 14 house department offices and crime laboratory space and state
  6 15 medical examiner laboratory, office, and related space:  
  6 16 .................................................. $  8,500,000
  6 17                     STATE BOARD OF REGENTS
  6 18    Sec. 14.  There is appropriated from the rebuild Iowa
  6 19 infrastructure fund to the state board of regents for the
  6 20 fiscal period beginning July 1, 2000, and ending June 30,
  6 21 2003, the following amounts, or so much thereof as is
  6 22 necessary, to be used for the purposes designated:
  6 23    1.  For improvements to Gilman hall at Iowa state
  6 24 university of science and technology, including the
  6 25 replacement of the heating, ventilation, and air conditioning
  6 26 system, replacement of the fume hood exhaust system, and the
  6 27 construction of an addition to house mechanical equipment:  
  6 28 FY 2000-2001...................................... $  8,500,000
  6 29 FY 2001-2002...................................... $  2,500,000
  6 30 FY 2002-2003...................................... $          0
  6 31    2.  For continued renovation of the biological sciences

  7 12    The state board of regents is authorized to enter into
  7 13 contracts for the full cost of carrying out the projects
  7 14 listed in subsections 1 through 3, for which appropriations
  7 15 are made in those subsections.  The state shall not be
  7 16 obligated for costs associated with contracts identified in
  7 17 this paragraph in excess of the funds appropriated by the
  7 18 general assembly.  
  7 19               STATE DEPARTMENT OF TRANSPORTATION
  7 20    Sec. 15.  There is appropriated from the rebuild Iowa
  7 21 infrastructure fund to the state department of transportation
  7 22 for the fiscal year beginning July 1, 2000, and ending June
  7 23 30, 2001, the following amounts, or so much thereof as is
  7 24 necessary, to be used for the purposes designated:
  7 25    1.  For vertical infrastructure improvements at all 10 of
  7 26 the commercial air service airports within the state:  
  7 27 .................................................. $  1,000,000
  7 28    One-half of the funds appropriated in this subsection shall
  7 29 be allocated equally between each commercial service airport,
  7 30 40 percent of the funds shall be allocated based on the
  7 31 percentage that the number of enplaned passengers at each
  7 32 commercial service airport bears to the total number of
  7 33 enplaned passengers in the state during the previous fiscal
  7 34 year, and 10 percent of the funds shall be allocated based on
  7 35 the percentage that the air cargo tonnage at each commercial
  8  1 service airport bears to the total air cargo tonnage in the
  8  2 state during the previous fiscal year.  In order for a
  8  3 commercial service airport to receive funding under this
  8  4 subsection, the airport shall be required to submit
  8  5 applications for funding of specific projects to the
  8  6 department for approval by the state transportation
  8  7 commission.
  8  8    2.  For deposit in an aviation hangar revolving loan fund,
  8  9 as created in this Act, for improvements to and design and
  8 10 construction of hangars at general aviation airports within
  8 11 the state:  
  8 12 .................................................. $    500,000
  8 13                  OFFICE OF TREASURER OF STATE
  8 14    Sec. 16.  There is appropriated from the rebuild Iowa
  8 15 infrastructure fund to the office of treasurer of state for
  8 16 the fiscal year beginning July 1, 2000, and ending June 30,
  8 17 2001, the following amount, or so much thereof as is
  8 18 necessary, to be used for the purpose designated:
  8 19    For county fair infrastructure improvements for
  8 20 distribution in accordance with chapter 174 to qualified fairs
  8 21 which belong to the association of Iowa fairs:  
  8 22 .................................................. $  1,060,000
  8 23                 COMMISSION OF VETERANS AFFAIRS
  8 24    Sec. 17.  There is appropriated from the rebuild Iowa
  8 25 infrastructure fund to the commission of veterans affairs for
  8 26 the fiscal year beginning July 1, 2000, and ending June 30,
  8 27 2001, the following amounts, or so much thereof as is
  8 28 necessary, to be used for the purposes designated:
  8 29    To supplement moneys appropriated in prior fiscal years for
  8 30 construction of a new dining hall and food services facility:  
  8 31 .................................................. $    992,000
  8 32    Sec. 18.  REVERSION.  Notwithstanding section 8.33, moneys
  8 33 appropriated in this division of this Act that remain
  8 34 unencumbered or unobligated at the close of the fiscal year
  8 35 that begins July 1, 2003, shall revert at the close of that
  9  1 fiscal year.  However, if the projects for which the moneys
  9  2 are appropriated are completed in an earlier fiscal year,
  9  3 unencumbered or unobligated moneys shall revert at the close
  9  4 of that fiscal year.
  9  5    Sec. 19.  EFFECTIVE DATE.  The following sections of this
  9  6 division of this Act, being deemed of immediate importance,
  9  7 take effect upon enactment:
  9  8    1.  Section 6, amending 1999 Iowa Acts, chapter 121,
  9  9 sections 11 and 12.
  9 10    2.  Sections 7 and 8, amending 1999 Iowa Acts, chapter 204,
  9 11 section 4, subsections 1 and 15.
  9 12    3.  Section 9, amending 1998 Iowa Acts, chapter 1219,
  9 13 section 6, subsection 1, unnumbered paragraphs 3 and 4, as
  9 14 amended and enacted by 1999 Iowa Acts, chapter 204, section
  9 15 39.
  9 16    4.  Section 11, amending 1998 Iowa Acts, chapter 1219,
  9 17 section 8.

  9 20                           DIVISION II
  9 21                  RESTORE THE OUTDOORS PROGRAM
  9 22                   AND ENVIRONMENT FIRST FUND
  9 23    Sec. 20.  Section 8.57, subsection 5, paragraph e, Code
  9 24 1999, is amended to read as follows:
  9 25    e.  Notwithstanding provisions to the contrary in sections
  9 26 99D.17 and 99F.11, for the fiscal years beginning July 1,
  9 27 1995, and July 1, 1996 for each fiscal year thereafter, not
  9 28 more than a total of sixty million dollars; and for each
  9 29 fiscal year thereafter; shall be deposited in the general fund
  9 30 of the state in any fiscal year pursuant to sections 99D.17
  9 31 and 99F.11.  The next thirty-five million dollars of the
  9 32 moneys directed to be deposited in the general fund of the
  9 33 state pursuant to sections 99D.17 and 99F.11 shall be
  9 34 deposited in the environment first fund created in section
  9 35 8.57A.  The total moneys in excess of the moneys deposited in
 10  1 the general fund of the state and the environment first fund
 10  2 in a fiscal year shall be deposited in the infrastructure fund
 10  3 and shall be used as provided in this section, notwithstanding
 10  4 section 8.60.
 10  5    Sec. 21.  NEW SECTION.  8.57A  ENVIRONMENT FIRST FUND.
 10  6    1.  An environment first fund is created under the
 10  7 authority of the department of management.  The fund shall
 10  8 consist of appropriations made to the fund and transfers of
 10  9 interest, earnings, and moneys from other funds as provided by
 10 10 law.  The fund shall be separate from the general fund of the
 10 11 state and the balance in the fund shall not be considered part
 10 12 of the balance of the general fund of the state.  However, the
 10 13 fund shall be considered a special account for the purposes of
 10 14 section 8.53, relating to generally accepted accounting
 10 15 principles.
 10 16    2.  Moneys in the environment first fund are not subject to
 10 17 section 8.33.  Notwithstanding section 12C.7, subsection 2,
 10 18 interest or earnings on moneys in the environment first fund
 10 19 shall be credited to the rebuild Iowa infrastructure fund.
 10 20    3.  Moneys in the fund in a fiscal year shall be used as
 10 21 appropriated by the general assembly for the protection,
 10 22 conservation, enhancement, or improvement of natural resources
 10 23 or the environment.
 10 24    Sec. 22.  Section 8.58, Code 1999, is amended to read as
 10 25 follows:
 10 26    8.58  EXEMPTION FROM AUTOMATIC APPLICATION.
 10 27    To the extent that moneys appropriated under section 8.57
 10 28 do not result in moneys being credited to the general fund
 10 29 under section 8.55, subsection 2, moneys appropriated under
 10 30 section 8.57 and moneys contained in the cash reserve fund,
 10 31 rebuild Iowa infrastructure fund, environment first fund, and
 10 32 Iowa economic emergency fund shall not be considered in the
 10 33 application of any formula, index, or other statutory
 10 34 triggering mechanism which would affect appropriations,
 10 35 payments, or taxation rates, contrary provisions of the Code
 11  1 notwithstanding.
 11  2    To the extent that moneys appropriated under section 8.57
 11  3 do not result in moneys being credited to the general fund
 11  4 under section 8.55, subsection 2, moneys appropriated under
 11  5 section 8.57 and moneys contained in the cash reserve fund,
 11  6 rebuild Iowa infrastructure fund, environment first fund, and
 11  7 Iowa economic emergency fund shall not be considered by an
 11  8 arbitrator or in negotiations under chapter 20.
 11  9    Sec. 23.  Section 461A.3A, subsection 2, unnumbered
 11 10 paragraph 1, Code 1999, is amended to read as follows:
 11 11    There is appropriated from the rebuild Iowa infrastructure
 11 12 fund for each fiscal year of the fiscal period beginning July
 11 13 1, 1997, and ending June 30, 2001 2004, the sum of three
 11 14 million dollars to the department for use in the restore the
 11 15 outdoors program.  Notwithstanding section 8.33, unencumbered
 11 16 or unobligated moneys remaining at the end of a fiscal year
 11 17 shall not revert but shall remain available for expenditure
 11 18 during the following fiscal year for purposes of the restore
 11 19 the outdoors program.  
 11 20         DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
 11 21    Sec. 24.  There is appropriated from the environment first
 11 22 fund to the department of agriculture and land stewardship for
 11 23 the fiscal year beginning July 1, 2000, and ending June 30,
 11 24 2001, the following amounts, or so much thereof as is
 11 25 necessary, to be used for the purposes designated:
 11 26    1.  To implement a conservation reserve enhancement program
 11 27 to restore and construct wetlands for the purposes of
 11 28 intercepting tile line runoff, reducing nutrient loss,
 11 29 improving water quality, and enhancing agricultural production
 11 30 practices:  
 11 31 .................................................. $  1,500,000
 11 32    2.  For implementation of a program that provides multi-
 11 33 objective resource protections for flood control, water
 11 34 quality, erosion control, and natural resource conservation:  
 11 35 .................................................. $  1,450,000
 12  1    3.  To initiate a statewide voluntary farm management
 12  2 demonstration program to demonstrate the effectiveness and
 12  3 adaptability of emerging practices in agronomy that protect
 12  4 water resources and provide other environmental benefits:  
 12  5 .................................................. $    850,000
 12  6    4.  For assisting farm operators in applying for project
 12  7 grants associated with the statewide voluntary farm management
 12  8 demonstration program:  
 12  9 .................................................. $     50,000
 12 10    5.  For assistance in writing plans for the reclamation of
 12 11 lands and water which were mined for coal or affected by
 12 12 mining processes:  
 12 13 .................................................. $     50,000
 12 14    6.  For deposit in the alternative drainage system
 12 15 assistance fund created in section 159.29A to be used for
 12 16 purposes of supporting the alternative drainage system
 12 17 assistance program as provided in section 159.29B:  
 12 18 .................................................. $  1,300,000
 12 19    Of the amount appropriated in this section, $300,000 shall
 12 20 be allocated to drainage district 176 to provide cost-share
 12 21 assistance for closing agricultural drainage wells and
 12 22 constructing alternative drainage systems in order to assist
 12 23 in raising the level of cost-share payments to 75 percent of
 12 24 the cost of the projects.
 12 25    7.  To provide financial assistance for the establishment
 12 26 of permanent soil and water conservation practices:  
 12 27 .................................................. $  2,000,000
 12 28    a.  Not more than 5 percent of the moneys appropriated in
 12 29 this subsection may be allocated for cost-sharing to abate
 12 30 complaints filed under section 161A.47.
 12 31    b.  Of the moneys appropriated in this subsection, 5
 12 32 percent shall be allocated for financial incentives to
 12 33 establish practices to protect watersheds above publicly owned
 12 34 lakes of the state from soil erosion and sediment as provided
 12 35 in section 161A.73.
 13  1    c.  Not more than 30 percent of a district's allocation of
 13  2 moneys as financial incentives may be provided for the purpose
 13  3 of establishing management practices to control soil erosion
 13  4 on land that is row-cropped, including but not limited to no-
 13  5 till planting, ridge-till planting, contouring, and contour
 13  6 strip-cropping as provided in section 161A.73.
 13  7    d.  The state soil conservation committee created in
 13  8 section 161A.4 may allocate moneys appropriated in this
 13  9 subsection to conduct research and demonstration projects to
 13 10 promote conservation tillage and nonpoint source pollution
 13 11 control practices.
 13 12    e.  The financial incentive payments may be used in
 13 13 combination with department of natural resources moneys.
 13 14    8.  To encourage and assist farmers in enrolling in the
 13 15 continuous sign-up federal conservation reserve program and
 13 16 work with them to enhance their revegetation efforts to
 13 17 improve water quality and habitat:

 13 19               DEPARTMENT OF ECONOMIC DEVELOPMENT
 13 20    Sec. 25.  There is appropriated from the environment first
 13 21 fund to the department of economic development for the fiscal
 13 22 year beginning July 1, 2000, and ending June 30, 2001, the
 13 23 following amount, or so much thereof as is necessary, to be
 13 24 used for the purpose designated:
 13 25    For deposit in the brownfield redevelopment fund to provide
 13 26 assistance under the brownfield redevelopment program, if the
 13 27 fund is created by the Seventy-eighth General Assembly, Second
 13 28 Session:  
 13 29 .................................................. $  3,000,000
 13 30                 DEPARTMENT OF NATURAL RESOURCES
 13 31    Sec. 26.  There is appropriated from the environment first
 13 32 fund to the department of natural resources for the fiscal
 13 33 year beginning July 1, 2000, and ending June 30, 2001, the
 13 34 following amounts, or so much thereof as is necessary, to be
 13 35 used for the purposes designated:
 14  1    1.  To establish a program to assist rural homeowners in
 14  2 improving on-site wastewater systems:  
 14  3 .................................................. $    600,000
 14  4    2.  To provide local watershed managers with geographic
 14  5 information system data for their use in developing,
 14  6 monitoring, and displaying results of their watershed work:  
 14  7 .................................................. $    195,000
 14  8    3.  For continuing the establishment and operation of water
 14  9 quality monitoring stations:  
 14 10 .................................................. $  1,950,000
 14 11    4.  To develop a program to support local volunteer
 14 12 management efforts in water quality programs:  
 14 13 .................................................. $     70,000
 14 14    5.  To establish and implement improved water quality
 14 15 planning, standards, and assessment:  
 14 16 .................................................. $    372,000
 14 17    6.  For contracting to assist department staff with the
 14 18 review of national pollutant discharge elimination system
 14 19 permits:  
 14 20 .................................................. $    250,000
 14 21    7.  To expand the floodplain protection education to better
 14 22 inform local officials that make decisions with regard to
 14 23 floodplain management:  
 14 24 .................................................. $    200,000
 14 25    8.  To identify an effective and efficient method of
 14 26 developing a total maximum daily load program:  
 14 27 .................................................. $    153,000
 14 28    9.  For the dredging of lakes, including necessary
 14 29 preparation for dredging, in accordance with the department's
 14 30 classification of Iowa lakes restoration report:  
 14 31 .................................................. $  2,900,000
 14 32    a.  Of the amount appropriated in this subsection, up to
 14 33 $200,000 may be used by the department to provide assistance
 14 34 to qualified applicants for purposes of financing capital
 14 35 improvements to natural or constructed lakes including but not
 15  1 limited to dredging, installation or repair of erosion control
 15  2 measures, and land acquisition.  To qualify for assistance, an
 15  3 applicant must be a nonprofit organization based in the
 15  4 community where the lake is located which is active in
 15  5 sponsoring improvements to the lake and is capable of managing
 15  6 or overseeing the improvements or be a governmental body.
 15  7 Assistance shall not be provided to construct a new lake.
 15  8 Notwithstanding any contrary provision of this subsection, the
 15  9 department may consider grants for any public lakes.
 15 10    b.  To qualify for assistance under paragraph "a", an
 15 11 applicant must demonstrate that existing or planned
 15 12 infrastructure and practices are capable of ensuring long-term
 15 13 benefits to the lake.  An applicant must also show that each
 15 14 dollar of assistance will be matched by one dollar contributed
 15 15 by a source other than the state.
 15 16    11.  For a community-based grant distribution program to
 15 17 provide funding for the planting of trees throughout the
 15 18 state:  
 15 19 .................................................. $    250,000
 15 20    12.  For a contribution towards the development of the
 15 21 Lewis and Clark rural water system:  
 15 22 .................................................. $     60,000
 15 23    13.  For continuation of the waste tire abatement program:  
 15 24 .................................................. $    500,000
 15 25    Of the amount appropriated in this subsection, up to
 15 26 $50,000 may be used by the department for administration costs
 15 27 of the program.  
 15 28    14.  For recreational grants to be used for the restoration
 15 29 or construction of recreational complexes or facilities under
 15 30 the recreational grant matching program:  
 15 31 .................................................. $  3,000,000
 15 32    Matching grants awarded from the funds appropriated in this
 15 33 subsection shall be awarded on a matching basis of one dollar
 15 34 for every two dollars the applicant had raised.
 15 35    The department shall give special consideration to
 16  1 recreational complex or facility projects which involve public
 16  2 and private sector participation.
 16  3    15.  For purposes of funding capital projects for the
 16  4 purposes specified in section 452A.79, and for expenditures
 16  5 for the local cost share grants to be used for capital
 16  6 expenditures to local governmental units for boating
 16  7 accessibility:  
 16  8 .................................................. $  2,300,000
 16  9    Sec. 27.  REVERSION.  Notwithstanding section 8.33, moneys
 16 10 appropriated in this division of this Act shall not revert on
 16 11 the close of the fiscal year for which they were appropriated,
 16 12 but shall remain available for expenditure for subsequent
 16 13 fiscal years or until the close of the fiscal year beginning
 16 14 July 1, 2003, or until the project for which the appropriation
 16 15 was made is completed, whichever is the earlier.  
 16 16                          DIVISION III
 16 17            RESOURCES ENHANCEMENT AND PROTECTION FUND
 16 18    Sec. 28.  Notwithstanding the amount of the standing
 16 19 appropriation from the general fund of the state under section
 16 20 455A.18, subsection 3, there is appropriated from the
 16 21 environment first fund to the Iowa resources enhancement and
 16 22 protection fund, in lieu of the appropriation made in section
 16 23 455A.18, for the fiscal year beginning July 1, 2000, and
 16 24 ending June 30, 2001, the following amount, to be allocated as
 16 25 provided in section 455A.19:  
 16 26 .................................................. $ 10,500,000
 16 27                           DIVISION IV
 16 28               MISCELLANEOUS CODE LANGUAGE CHANGES
 16 29                      AND OTHER PROVISIONS
 16 30    Sec. 29.  Section 18.3, subsection 7, Code 1999, is amended
 16 31 by adding the following new unnumbered paragraph:
 16 32    NEW UNNUMBERED PARAGRAPH.  If the department intends to
 16 33 bill a state agency for a service provided by the department
 16 34 under this subsection, the department shall notify the state
 16 35 agency of the department's intention and of the costs of
 17  1 providing the service prior to providing the service.  The
 17  2 state agency may request that all or a part of the service not
 17  3 be provided by the department if all or a part of the service
 17  4 will be provided by a person employed by the state agency or a
 17  5 person under contract with the state.  An action by the
 17  6 department or a state agency related to the provision of,
 17  7 billing for, or request to not perform a service under this
 17  8 subsection, is subject to review by the executive council upon
 17  9 complaint from any state agency adversely affected.
 17 10    Sec. 30.  NEW SECTION.  18A.6  CAPITOL COMPLEX PROJECTS.
 17 11    All capital projects on the capitol complex shall be
 17 12 planned, approved, and funded only after considering the
 17 13 guiding principles enunciated in any capitol complex master
 17 14 plan adopted by the commission on or after January 1, 2000.
 17 15 At a minimum, the extent to which the proposed capital project
 17 16 does all of the following shall be considered:
 17 17    1.  Preserves and enhances the dignity, beauty, and
 17 18 architectural integrity of the capitol building, other state
 17 19 office buildings, and the capitol grounds.
 17 20    2.  Protects and enhances the public open spaces on the
 17 21 capitol complex when deemed necessary for public use and
 17 22 enjoyment.
 17 23    3.  Protects the most scenic public views to and from the
 17 24 capitol building.
 17 25    4.  Recognizes the diversity of adjacent neighborhoods and
 17 26 reinforces the connection of the capitol complex to its
 17 27 neighbors and the city of Des Moines.
 17 28    5.  Accommodates pedestrian and motorized traffic that
 17 29 achieves appropriate public accessibility.
 17 30    This section applies only to projects for which a
 17 31 construction site was not determined prior to the effective
 17 32 date of this Act.
 17 33    Sec. 31.  NEW SECTION.  330.2  AVIATION HANGAR REVOLVING
 17 34 LOAN FUND.
 17 35    An aviation hangar revolving loan fund is established in
 18  1 the office of the treasurer of state under the control of the
 18  2 state department of transportation.  Moneys in the fund are
 18  3 appropriated for the purposes set forth in this section.
 18  4 Moneys in the fund shall be expended for loans to provide
 18  5 assistance for the design, construction, or improvement of
 18  6 hangars at general aviation airports in the state.  The
 18  7 department shall adopt rules to administer a program for the
 18  8 granting and administration of loans under this section.  The
 18  9 department may enter into agreements with general aviation
 18 10 airports for carrying out the purposes of this section.
 18 11 Moneys received as loan repayments shall be credited to the
 18 12 aviation hangar revolving loan fund.  Notwithstanding section
 18 13 8.33, moneys in the aviation hangar revolving loan fund shall
 18 14 not revert to any other fund but shall remain available
 18 15 indefinitely for expenditure under this section.
 18 16    Sec. 32.  1999 Iowa Acts, chapter 204, section 17, is
 18 17 amended by adding the following new unnumbered paragraph:
 18 18    NEW UNNUMBERED PARAGRAPH.  Notwithstanding section 8.33,
 18 19 moneys appropriated for noncapital expenditures in this
 18 20 division of this Act shall not revert on the close of the
 18 21 fiscal year for which they were appropriated, but shall remain
 18 22 available for expenditure for subsequent fiscal years or until
 18 23 the close of the fiscal year beginning July 1, 2003, or until
 18 24 the project for which the appropriation was made is completed,
 18 25 whichever is the earlier.
 18 26    Sec. 33.  EFFECTIVE DATE.  This division of this Act, being
 18 27 deemed of immediate importance, takes effect upon enactment.  
 18 28                           EXPLANATION
 18 29    This bill makes appropriations from the rebuild Iowa
 18 30 infrastructure fund for various capital and other projects.
 18 31 These appropriations include capital projects for the
 18 32 departments of corrections, cultural affairs, economic
 18 33 development, general services, public safety, and
 18 34 transportation, and for the department for the blind, state
 18 35 board of regents, the judicial branch, the office of treasurer
 19  1 of state, and the commission of veterans affairs.
 19  2    The bill creates an environment first fund under the
 19  3 authority of the department of management.  The fund is to be
 19  4 separate from the general fund of the state and is to consist
 19  5 of appropriations made to the fund and transfers of interest,
 19  6 earnings, and moneys from other funds as provided by law.
 19  7 Moneys in the fund in a fiscal year are to be used as
 19  8 appropriated by the general assembly for the protection,
 19  9 conservation, enhancement, or improvement of natural resources
 19 10 or the environment.  The bill also provides that a portion of
 19 11 the gambling revenues currently being deposited in the rebuild
 19 12 Iowa infrastructure fund are to be deposited into the
 19 13 environment first fund.
 19 14    The bill also extends the restore the outdoors program,
 19 15 which provides a standing appropriation from the rebuild Iowa
 19 16 infrastructure fund for vertical infrastructure projects at
 19 17 state parks and other public facilities managed by the
 19 18 department of natural resources, through the fiscal year
 19 19 ending June 30, 2004.  Currently, the standing appropriation
 19 20 is scheduled to cease in the fiscal year ending June 30, 2001.
 19 21    The bill appropriates $10.5 million from the environment
 19 22 first fund to the resources enhancement and protection fund in
 19 23 lieu of the $20 million appropriated from the general fund of
 19 24 the state.
 19 25    The bill amends a provision in Code section 18.3 to require
 19 26 the department of general services to notify a state agency of
 19 27 the department's intention to bill the state agency for
 19 28 certain architectural and construction-related services to be
 19 29 provided by the department, and of the cost of such services.
 19 30 The state agency may request that all or a portion of the
 19 31 service not be provided by the department if the same service
 19 32 will be provided by another person.  The department or a state
 19 33 agency may file a complaint with the executive council
 19 34 regarding the provision of, billing for, or request to not
 19 35 perform the service.
 20  1    The bill also creates new Code section 18A.6 providing
 20  2 procedural requirements applicable to capital projects on the
 20  3 capitol complex.  The bill states that such projects shall be
 20  4 planned, approved, and funded only after considering the
 20  5 guiding principles set forth in any capitol complex master
 20  6 plan adopted by the capitol planning commission on or after
 20  7 January 1, 2000.  The bill then lists several of the
 20  8 principles which shall be given priority consideration.  The
 20  9 provision is effective upon the bill's enactment.
 20 10    The bill creates an aviation hangar revolving loan fund in
 20 11 new Code section 330.2, to be used by the state department of
 20 12 transportation for loans to provide assistance for the design,
 20 13 construction, or improvement of hangars at general aviation
 20 14 airports in the state.
