PAG LIN 1 1 Section 1. Section 142B.1, subsection 1, Code 1999, is 1 2 amended to read as follows: 1 3 1. "Bar" means an establishment or a separate portion of 1 4 an establishment where one can purchase and consume alcoholic 1 5 beverages as defined in section 123.3, subsection 4, but 1 6 excluding any establishmentor portion of the establishment1 7 having table and seating facilitiesfor serving of meals to1 8more than fifty people at one time andwhere, in consideration 1 9 of payment, meals are servedat tablesto the public. 1 10 Sec. 2. Section 142B.2, subsection 3, unnumbered paragraph 1 11 1, Code 1999, is amended to read as follows: 1 12 Where smoking areas are designated, existing physical 1 13 barriers and existing ventilation systems shall be used to 1 14 minimize the toxic effect of smoke in adjacent nonsmoking 1 15 areas. In the case of public places consisting of a single 1 16 room, the provisions of this law shall be considered met if 1 17 one side of the room is reserved and posted as a no-smoking 1 18 area.NoA public place other than a bar shall not be 1 19 designated as a smoking area in its entirety. If a bar has 1 20 within its premises a nonsmoking area, this designation shall 1 21 be posted on all entrances normally used by the public. If an 1 22 establishment has tables and seating facilities at which, in 1 23 consideration of payment meals are served to the public, and 1 24 also has a separate portion of the establishment designated 1 25 solely for the purchase and consumption of alcoholic beverages 1 26 as defined in section 123.3, subsection 4, the only portion of 1 27 the establishment that may be designated as a smoking area is 1 28 that separate portion of the establishment. 1 29 EXPLANATION 1 30 This bill provides that an establishment, regardless of 1 31 size of the establishment, having table and seating facilities 1 32 at which, in consideration of payment meals are served to the 1 33 public, is not considered a "bar" for the purposes of Code 1 34 chapter 142B (smoking prohibitions). The bill also provides 1 35 that if an establishment provides table and seating facilities 2 1 at which meals are served for consideration to the public and 2 2 also has a separate portion designated solely for the purchase 2 3 and consumption of alcoholic beverages, the only portion of 2 4 the establishment that may be designated as a smoking area is 2 5 that separate portion of the establishment. 2 6 LSB 6460HH 78 2 7 pf/cf/24
