PAG LIN 1 1 HOUSE FILE 2368 1 2 1 3 AN ACT 1 4 RELATING TO WEIGHT RESTRICTIONS ON CERTAIN IMPLEMENTS OF 1 5 HUSBANDRY AND PROVIDING FOR A STUDY. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 321.463, subsection 4, paragraph b, 1 10 Code Supplement 1999, is amended by striking the paragraph and 1 11 inserting in lieu thereof the following: 1 12 b. (1) Notwithstanding any provision of this section to 1 13 the contrary, the weight on any one axle of a fence-line 1 14 feeder, grain cart, or tank wagon operated on the highways of 1 15 this state shall not exceed twenty-four thousand pounds from 1 16 February 1 through May 31 or twenty-eight thousand pounds from 1 17 June 1 through January 31, provided, however, that the maximum 1 18 gross vehicle weight of the fence-line feeder, grain cart, or 1 19 tank wagon shall not exceed ninety-six thousand pounds. 1 20 A fence-line feeder, grain cart, or tank wagon shall comply 1 21 with the other provisions of this section and chapter when 1 22 operated over a bridge in this state. A local authority may 1 23 issue a special permit, based on a statewide standard 1 24 developed by the department, allowing the operation over a 1 25 bridge within its jurisdiction of a fence-line feeder, grain 1 26 cart, or tank wagon with a weight in excess of the weights 1 27 allowed under this chapter. 1 28 (2) For purposes of this paragraph "b", "highway" does not 1 29 include a bridge. 1 30 For purposes of this paragraph "b", "fence-line feeder, 1 31 grain cart, or tank wagon" means all of the following: 1 32 (a) A fence-line feeder, grain cart, or tank wagon 1 33 manufactured on or after July 1, 2001. 1 34 (b) After July 1, 2005, any fence-line feeder, grain cart, 1 35 or tank wagon. 2 1 The year of manufacture of a fence-line feeder, grain cart, 2 2 or tank wagon manufactured on or after July 1, 2001, shall be 2 3 permanently made a part of the identification plate on the 2 4 vehicle. Fraudulently altering or defacing or attempting to 2 5 fraudulently alter or deface the year of manufacture or other 2 6 product identification number on a fence-line feeder, grain 2 7 cart, or tank wagon is a violation of section 321.92. 2 8 Sec. 2. IMPLEMENTS OF HUSBANDRY STUDY. The state 2 9 department of transportation shall, in consultation with 2 10 manufacturers and distributors of implements of husbandry, 2 11 agricultural associations, and the Iowa state association of 2 12 counties, complete the study described in 1999 Iowa Acts, 2 13 chapter 108, section 12, as it pertains to tracked vehicles. 2 14 The department shall report its findings and recommendations 2 15 to the general assembly by December 1, 2000. 2 16 2 17 2 18 2 19 BRENT SIEGRIST 2 20 Speaker of the House 2 21 2 22 2 23 2 24 MARY E.
