  1  1    Section 1.  Section 321.178, subsection 3, Code Supplement
  1  2 1999, is amended to read as follows:
  1  3    3.  DRIVER'S LICENSE RECIPROCITY.
  1  4    a.  The department may issue a class C or M driver's
  1  5 license to a person who is sixteen or seventeen years of age
  1  6 and who is a current resident of the state, but who has been
  1  7 driving as a resident of another state or country for at least
  1  8 one year prior to residency within the state.
  1  9    b.  The following criteria must be met prior to issuance of
  1 10 a driver's license pursuant to this subsection:
  1 11    (1)  The minor must reside with a parent or guardian.
  1 12    (2)  The minor must have driven under a valid driver's
  1 13 license for at least one year in the prior state or country of
  1 14 residence.  Six months of the one year one-year computation
  1 15 may include driving with an instruction permit.
  1 16    (3)  The minor must have had no moving traffic violations
  1 17 on the minor's driving record.
  1 18    (4)  The minor must pass the written and driving skills
  1 19 tests as required by the department, but is not required to
  1 20 have taken a driver's education class.
  1 21    c.  A person who has been driving as a resident of another
  1 22 country for at least one year prior to residency within the
  1 23 state may be issued a class C or class M driver's license
  1 24 under this subsection only if the department determines the
  1 25 driver's education and licensing requirements of the other
  1 26 country are sufficiently similar to the driver's education and
  1 27 licensing requirements of this state.
  1 28    Sec. 2.  Section 321.180B, subsection 2, unnumbered
  1 29 paragraph 1, Code Supplement 1999, is amended to read as
  1 30 follows:
  1 31    The department may issue an intermediate driver's license
  1 32 to a person sixteen or seventeen years of age who possesses an
  1 33 instruction permit issued under subsection 1 or a comparable
  1 34 instruction permit issued by another state or country for a
  1 35 minimum of six months immediately preceding application, and
  2  1 who presents an affidavit signed by a parent or guardian on a
  2  2 form to be provided by the department that the permittee has
  2  3 accumulated a total of twenty hours of street or highway
  2  4 driving of which two hours were conducted after sunset and
  2  5 before sunrise and the street or highway driving was with the
  2  6 permittee's parent, guardian, instructor, a person certified
  2  7 by the department, or a person at least twenty-five years of
  2  8 age who had written permission from a parent or guardian to
  2  9 accompany the permittee, and whose driving privileges have not
  2 10 been suspended, revoked, or barred under this chapter, or
  2 11 chapter 321J, or a similar law of another state or country
  2 12 during, and who has been accident and conviction free
  2 13 continuously for, the six-month period immediately preceding
  2 14 the application for an intermediate license.  An applicant for
  2 15 an intermediate license must meet the requirements of section
  2 16 321.186, including satisfactory completion of driver education
  2 17 as required in section 321.178, and payment of the required
  2 18 license fee before an intermediate license will be issued.  A
  2 19 person issued an intermediate license must limit the number of
  2 20 passengers in the motor vehicle when the intermediate licensee
  2 21 is operating the motor vehicle to the number of passenger
  2 22 safety belts.
  2 23    Sec. 3.  Section 321.180B, subsection 4, Code Supplement
  2 24 1999, is amended to read as follows:
  2 25    4.  FULL DRIVER'S LICENSE.  A full driver's license may be
  2 26 issued to a person seventeen years of age who possesses an
  2 27 intermediate license issued under subsection 2 or a comparable
  2 28 intermediate license issued by another state or country for a
  2 29 minimum of twelve months immediately preceding application,
  2 30 and who presents an affidavit signed by a parent or guardian
  2 31 on a form to be provided by the department that the
  2 32 intermediate licensee has accumulated a total of ten hours of
  2 33 street or highway driving of which two hours were conducted
  2 34 after sunset and before sunrise and the street or highway
  2 35 driving was with the licensee's parent, guardian, instructor,
  3  1 a person certified by the department, or a person at least
  3  2 twenty-five years of age who had written permission from a
  3  3 parent or guardian to accompany the licensee, whose driving
  3  4 privileges have not been suspended, revoked, or barred under
  3  5 this chapter, or chapter 321J, or a similar law of another
  3  6 state or country during, and who has been accident and
  3  7 conviction free continuously for, the twelve-month period
  3  8 immediately preceding the application for a full driver's
  3  9 license, and who has paid the required fee.  
  3 10                           EXPLANATION
  3 11    This bill allows the state department of transportation to
  3 12 issue a driver's license to a person who is 16 or 17 years of
  3 13 age and who is a current resident of the state, who has been
  3 14 driving as a resident of another country for at least one year
  3 15 prior to residency within the state if the person resides with
  3 16 a parent or guardian, the person drove under a valid driver's
  3 17 license or instruction permit and driver's license for at
  3 18 least one year in the prior country of residence, the person
  3 19 had no moving traffic violations on the person's driving
  3 20 record, and the person passed the written and driving skills
  3 21 tests as required by the department.  In order to issue such a
  3 22 license, the department must determine that the driver's
  3 23 education and licensing requirements of the other country are
  3 24 sufficiently similar to the driver's education and licensing
  3 25 requirements of this state.
  3 26    The bill also allows the department to issue an
  3 27 intermediate license or a full license to certain minors who
  3 28 possess an instruction permit or intermediate license,
  3 29 respectively, issued by another country, if the permit or
  3 30 license is comparable to a permit or license issued in this
  3 31 state.
