  1  1    Section 1.  Section 321J.22, subsections 2, 4, and 5, Code
  1  2 1999, are amended to read as follows:
  1  3    2.  a.  The course provided according to this section shall
  1  4 be offered on a regular basis at each community college as
  1  5 defined in section 260C.2, and at substance abuse treatment
  1  6 programs licensed under chapter 125.
  1  7    b.  Enrollment in the courses is not limited to persons
  1  8 ordered to enroll, attend, and successfully complete the
  1  9 course required under sections 321J.2 and 321J.17, subsection
  1 10 2.
  1 11    c.  The course required by this section shall be: taught
  1 12    (1)  Taught by the a community colleges college under the
  1 13 supervision of the department of education and approved or by
  1 14 a substance abuse treatment program licensed under chapter
  1 15 125.
  1 16    (2)  Approved jointly by the department of education and by
  1 17 substance abuse treatment programs licensed under chapter 125.
  1 18    d.  The department of education and substance abuse
  1 19 treatment programs licensed under chapter 125 shall each
  1 20 establish reasonable fees to defray the expense of obtaining
  1 21 classroom space, instructor salaries, and class materials.
  1 22    e.  A person shall not be denied enrollment in a course by
  1 23 reason of the person's indigency.
  1 24    4.  The department of education and substance abuse
  1 25 treatment programs licensed under chapter 125 shall jointly
  1 26 prepare a complete list of the locations of the courses taught
  1 27 under this section, the dates and times taught, the procedure
  1 28 for enrollment, and the schedule of course fees.  The list
  1 29 shall be kept current and a copy of the list shall be sent to
  1 30 each court having jurisdiction over offenses provided in this
  1 31 chapter.
  1 32    5.  The department of education and substance abuse
  1 33 treatment programs licensed under chapter 125 shall jointly
  1 34 maintain enrollment, attendance, successful and nonsuccessful
  1 35 completion data on the persons ordered to enroll, attend, and
  2  1 successfully complete a course for drinking drivers.  This
  2  2 data shall be forwarded to the court.  
  2  3                           EXPLANATION
  2  4    This bill amends Code section 321J.22, relating to the
  2  5 course for drinking drivers, ordered under Code chapter 321J
  2  6 and Code section 707.6A for operating while intoxicated
  2  7 offenders, implementing the recommendation of the OWI course
  2  8 requirements interim study committee.
  2  9    The bill permits the course to be taught by substance abuse
  2 10 treatment programs licensed under Code chapter 125, as well as
  2 11 by community colleges.  The bill requires the department of
  2 12 education to work with the substance abuse treatment programs
  2 13 in approving the course, creating a list of course times and
  2 14 dates to be supplied to the courts, and maintaining course
  2 15 completion statistics.
