PAG LIN 1 1 Section 1. Section 347.9, Code Supplement 1999, is amended 1 2 to read as follows: 1 3 347.9 TRUSTEES APPOINTMENT TERMS OF OFFICE. 1 4 1. When it has been determined by the voters of a county 1 5 to establish a county public hospital, the board shall appoint 1 6 seven trustees chosen from among the resident citizens of the 1 7 county with reference to their fitness for office, and not 1 8 more than four of the trustees shall be residents of the city 1 9 at which the hospital is located. The trustees shall hold 1 10 office until the following general election, at which time 1 11 their successors shall be elected, two for a term of two 1 12 years, two for four years, and three for six years, and they 1 13 shall determine by lot their respective terms, and thereafter 1 14 their successors shall be elected for regular terms of six 1 15 years each. 1 16 2. A person other than a physician or the spouse of such a 1 17 personwithwho has medical or special staff privileges in the 1 18 county public hospital or who receives direct or indirect 1 19 compensation in an amount greater than one thousand five 1 20 hundred dollars in a calendar year from the county public 1 21 hospital or direct or indirect compensation in an amount 1 22 greater than one thousand five hundred dollars in a calendar 1 23 year from a person contracting for services with the hospital 1 24 shall not be eligible to serve as a trustee for that county 1 25 public hospital. 1 26 3. For the purposes of this section and section 347.15, 1 27 "physician" means a person licensed to practice medicine and 1 28 surgery pursuant to chapter 148, osteopathy pursuant to 1 29 chapter 150, or osteopathic medicine and surgery pursuant to 1 30 chapter 150A. 1 31 Sec. 2. Section 347.15, Code 1999, is amended to read as 1 32 follows: 1 33 347.15 PECUNIARY INTEREST PROHIBITED EXCEPTIONS. 1 34 A trustee other than a physician shall not have, directly 1 35 or indirectly, any pecuniary interest in the purchase or sale 2 1 of any commodities or supplies procured for or disposed of by 2 2 a county hospital. This section does not apply to a purchase 2 3 or sale of commodities or supplies which benefits a trustee if 2 4 the benefit to the trustee does not exceed one thousand five 2 5 hundred dollars in a fiscal year or to a purchase or sale made 2 6 by a trustee of the board of hospital trustees through 2 7 competitive bid which is issued in written form and is 2 8 publicly invited and opened. 2 9 EXPLANATION 2 10 This bill removes the prohibition against physicians 2 11 serving as trustees on county public hospital boards and makes 2 12 a conforming change relating to the pecuniary interest of a 2 13 physician in the purchase or sale of commodities or supplies 2 14 related to a county hospital. 2 15 LSB 5118HH 78 2 16 pf/as/5
