  1  1    Section 1.  Section 455B.482, Code 1999, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  16.  "White goods" means a major household
  1  4 appliance including a refrigerator, stove, oven, deep freeze
  1  5 freezer, dishwasher, clothes washer, clothes dryer, and
  1  6 microwave oven.
  1  7    Sec. 2.  Section 455B.484, Code 1999, is amended by adding
  1  8 the following new subsection:
  1  9    NEW SUBSECTION.  15.  Develop and administer the white
  1 10 goods cleanup day program established in section 455B.489.
  1 11    Sec. 3.  NEW SECTION.  455B.489  WHITE GOODS CLEANUP
  1 12 PROGRAM.
  1 13    1.  The waste management assistance division shall conduct
  1 14 programs to collect and dispose of white goods.  The program
  1 15 shall be known as "white goods cleanup days".  The waste
  1 16 management assistance division shall promote and conduct the
  1 17 program and shall, by contracting with an approved unit of
  1 18 local government, private organization or business, or person,
  1 19 collect and properly dispose of white goods.  A unit of local
  1 20 government, private organization or business, or person
  1 21 desiring to contract with the waste management assistance
  1 22 division to collect and dispose of white goods shall apply to
  1 23 the division for approval.  In order to be approved, the
  1 24 applicant must be in compliance with all applicable state and
  1 25 federal laws and administrative rules.  The waste management
  1 26 assistance division shall establish maximum amounts of white
  1 27 goods which may be accepted from a person during the white
  1 28 goods cleanup days program.  Amounts accepted from a person
  1 29 above the maximum shall be limited by the waste management
  1 30 assistance division and may be subject to a fee set by the
  1 31 division, but the division shall not assess a fee for amounts
  1 32 accepted below the maximum amount.  The waste management
  1 33 assistance division shall designate the times and dates for
  1 34 the collection of white goods.  In order to achieve the
  1 35 maximum benefit from the program, the waste management
  2  1 assistance division shall offer white goods cleanup days on a
  2  2 statewide basis and provide at least one white goods cleanup
  2  3 day in each departmental region.  White goods cleanup days
  2  4 shall be offered in both rural and urban areas to provide a
  2  5 comparison of response levels and to test the viability of
  2  6 multicounty white goods cleanup days.  The waste management
  2  7 assistance division shall prepare an annual report citing the
  2  8 results and costs of the program for submittal to the general
  2  9 assembly.
  2 10    Sec. 4.  Section 455E.11, subsection 2, paragraph c,
  2 11 unnumbered paragraph 1, Code 1999, is amended to read as
  2 12 follows:
  2 13    A household hazardous waste account.  The moneys collected
  2 14 pursuant to section 455F.7 and moneys collected pursuant to
  2 15 section 29C.8A which are designated for deposit, shall be
  2 16 deposited in the household hazardous waste account.  Two
  2 17 thousand dollars is appropriated annually to the Iowa
  2 18 department of public health to carry out departmental duties
  2 19 under section 135.11, subsections 20 and 21, and section
  2 20 139.35.  The remainder of the account shall be used to fund
  2 21 toxic cleanup days, white goods cleanup days, and the efforts
  2 22 of the department to support a collection system for household
  2 23 hazardous materials and white goods, including public
  2 24 education programs, training, and consultation of local
  2 25 governments in the establishment and operation of permanent
  2 26 collection systems, and the management of collection sites,
  2 27 education programs, and other activities pursuant to chapter
  2 28 455F, including the administration of the household hazardous
  2 29 materials permit program by the department of revenue and
  2 30 finance.  
  2 31                           EXPLANATION
  2 32    This bill requires the waste management assistance division
  2 33 of the department of natural resources to conduct a white
  2 34 goods cleanup days program designed to collect and dispose of
  2 35 white goods.  The bill defines "white goods" as a major
  3  1 household appliance.  The bill provides that the division
  3  2 shall promote and conduct the program and shall, by contract
  3  3 with an approved unit of local government, private
  3  4 organization or business, or person, collect and dispose of
  3  5 white goods.  The bill provides that a unit of local
  3  6 government, private organization or business, or person
  3  7 interested in contracting with the division must file an
  3  8 application with the division for approval.  To be approved,
  3  9 the applicant must be in compliance with all applicable state
  3 10 and federal laws and administrative rules.  The bill provides
  3 11 that the division shall establish maximum amounts of white
  3 12 goods to be accepted from a person during a white goods
  3 13 cleanup day and that white goods cleanup days shall be offered
  3 14 in both rural and urban areas.  The bill provides that the
  3 15 division shall prepare an annual report citing the results and
  3 16 costs of the program for submittal to the general assembly.
  3 17    The bill provides that costs associated with white goods
  3 18 cleanup days shall be paid out of the hazardous waste account
  3 19 of the groundwater protection fund.
