1 1 Section 1. NEW SECTION. 514I.11 HAWK-I TRUST FUND.
1 2 1. A HAWK-I trust fund is created in the state treasury
1 3 under the authority of the department of human services, in
1 4 which all state appropriations for the program shall be
1 5 deposited and used to carry out the purposes of this chapter.
1 6 Other revenues of the program such as grants, contributions,
1 7 and participant payments shall not be considered revenue of
1 8 the state, but rather shall be funds of the program for
1 9 deposit in the fund.
1 10 2. The trust fund shall be separate from the general fund
1 11 of the state and shall not be considered part of the general
1 12 fund of the state. The moneys in the trust fund are not
1 13 subject to section 8.33 and shall not be transferred, used,
1 14 obligated, appropriated, or otherwise encumbered except as
1 15 provided in this chapter. However, except as provided in
1 16 section 8.58, the balance in the fund may be used in
1 17 determining the cash position of the general fund of the state
1 18 for the payment of obligations. Notwithstanding section
1 19 12C.7, subsection 2, interest or earnings on moneys deposited
1 20 in the trust fund shall be credited to the trust fund.
1 21 EXPLANATION
1 22 This bill establishes a healthy and well kids in Iowa
1 23 (HAWK-I) trust fund in the state treasury under the authority
1 24 of the department of human services. All state appropriations
1 25 for the program as well as any grants, contributions, and
1 26 participant payments are considered funds of the program for
1 27 deposit in the fund. The fund is not part of the general fund
1 28 and moneys in the fund are not to revert to the general fund
1 29 at the end of the fiscal year. Interest and earnings on the
1 30 moneys in the fund are to be credited to the fund.
