1 4 CREATING THE NEW CRIMINAL OFFENSE OF DISARMING A PEACE
1 5 OFFICER OF A DANGEROUS WEAPON.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. NEW SECTION. 708.13 DISARMING A PEACE OFFICER
1 10 OF A DANGEROUS WEAPON.
1 11 1. A person who knowingly or intentionally removes or
1 12 attempts to remove a dangerous weapon, as defined in section
1 13 702.7, from the possession of a peace officer, as defined in
1 14 section 724.2A, when the officer is in the performance of any
1 15 act which is within the scope of the lawful duty or authority
1 16 of that officer and the person knew or should have known the
1 17 individual to be a peace officer, commits the offense of
1 18 disarming a peace officer.
1 19 2. A person who disarms or attempts to disarm a peace
1 20 officer is guilty of a class "D" felony.
1 21 3. A person who discharges the dangerous weapon while
1 22 disarming or attempting to disarm the peace officer commits a
1 23 class "C" felony.
