  1  1    Section 1.  Section 56.14, subsection 2, Code 1999, is
  1  2 amended to read as follows:
  1  3    2.  a.  (1)  Yard signs shall not be placed on any of the
  1  4 following property:
  1  5    (a)  Property which adjoins a city, county, or state
  1  6 roadway, sooner than forty-five days preceding a primary or
  1  7 general election and.  Yard signs on such property shall be
  1  8 removed within seven days after the primary or general
  1  9 election in which the name of the particular candidate or
  1 10 ballot issue described on the yard sign appears on the ballot.
  1 11    (b)  School property, if the school is a polling place.
  1 12    (2)  Yard signs are subject to removal by highway
  1 13 authorities as provided in section 319.13, or by county or
  1 14 city law enforcement authorities in a manner consistent with
  1 15 section 319.13.  The placement or erection of yard signs shall
  1 16 be exempt from the requirements of chapter 480.  Notice may be
  1 17 provided to the chairperson of the appropriate county central
  1 18 committee if the highway authorities are unable to provide
  1 19 notice to the candidate, candidate's committee, or political
  1 20 committee regarding the yard sign.
  1 21    b.  This subsection does not prohibit the placement of yard
  1 22 signs on agricultural land owned by individuals or by a family
  1 23 farm operation as defined in section 9H.1, subsections 8, 8A,
  1 24 9, and 10; does not prohibit the placement of yard signs on
  1 25 property owned by private individuals who have rented or
  1 26 leased the property to a corporation, if the prior written
  1 27 permission of the property owner is obtained; and does not
  1 28 prohibit the placement of yard signs on residential property
  1 29 owned by a corporation but rented or leased to a private
  1 30 individual if the prior permission of the renter or lessee is
  1 31 obtained.  For the purposes of this chapter, "agricultural
  1 32 land" means agricultural land as defined in section 9H.1.
  1 33    3.  a.  Published material shall not be placed or worn on
  1 34 or taken to any school property by any person, if the school
  1 35 is a polling place.
  2  1    b.  "Published material" means the same as defined in
  2  2 subsection 1.  
  2  3                           EXPLANATION 
  2  4    This bill amends Code section 56.14, regarding placement of
  2  5 published political material.  The bill prohibits placement of
  2  6 yard signs and other political material on school property, if
  2  7 the school is a polling place.
  2  8    Violation of Code section 56.14 is a serious misdemeanor,
  2  9 pursuant to Code section 56.16.
