1 1 Section 1. Section 321.11, Code 1999, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The department shall not sell
1 4 personal information which is in the form of a person's
1 5 photograph or digital image or a digital reproduction of a
1 6 person's photograph, regardless of whether an individual has
1 7 elected to prohibit disclosure of the information to the
1 8 general public. This paragraph does not prohibit the
1 9 department from collecting reasonable fees for copies of
1 10 records or other services provided pursuant to section 22.3,
1 11 321.10, or 622.46.
1 12 EXPLANATION
1 13 This bill amends Code section 321.11 to provide that the
1 14 state department of transportation shall not sell personal
1 15 information contained in the department's records which is in
1 16 the form of a person's photograph or digital image or a
1 17 digital reproduction of a person's photograph. The
1 18 prohibition applies whether or not an individual has elected
1 19 to prohibit disclosure of the information to the general
1 20 public. Collection of fees for copies of records or other
1 21 incidental services provided by the department is not
1 22 prohibited.
1 23 Code section 321.11 defines "personal information" as
1 24 information that identifies a person, including a person's
1 25 photograph, social security number, driver's license number,
1 26 name, address, telephone number, and medical or disability
1 27 information. "Personal information" does not include
1 28 information on vehicular accidents, driving violations, and
1 29 driver's status or a person's zip code.
