  1  1    Section 1.  DIVISION OF VOCATIONAL REHABILITATION –
  1  2 CENTERS FOR INDEPENDENT LIVING.  There is appropriated from
  1  3 the general fund of the state to the department of education
  1  4 for the fiscal year beginning July 1, 1999, and ending June
  1  5 30, 2000, the following amount, or so much thereof as is
  1  6 necessary, to be used for the purpose designated:
  1  7    For grants administered by the division of vocational
  1  8 rehabilitation, in accordance with the provisions of this
  1  9 section:  
  1 10 .................................................. $  1,000,000
  1 11    1.  The general assembly finds that independent living
  1 12 centers enable persons with disabilities to access independent
  1 13 living skills training, peer counseling, information and
  1 14 referral services, and individual and system advocacy
  1 15 activities, and that access to these resources is essential
  1 16 for persons with disabilities to realize their rights and
  1 17 responsibilities as citizens.
  1 18    2.  The moneys appropriated in this Act are allocated as
  1 19 follows:
  1 20    a.  Seventy percent for grants to existing centers for
  1 21 independent living.
  1 22    b.  Twenty percent for grants to establish new centers for
  1 23 independent living.
  1 24    c.  Ten percent for use by the statewide independent living
  1 25 council for identifying and studying communities that are not
  1 26 served by a center for independent living.
  1 27    Notwithstanding section 8.33, moneys appropriated in this
  1 28 Act which remain unexpended or unobligated at the close of the
  1 29 fiscal year shall not revert but shall remain available in the
  1 30 succeeding fiscal year and shall be used only for the purposes
  1 31 designated in paragraphs "b" and "c".
  1 32    3.  The division of vocational rehabilitation shall
  1 33 distribute the moneys appropriated in this section for grants
  1 34 to independent living centers in accordance with a plan
  1 35 developed in consultation with the state association of
  2  1 independent living.  Grants shall be limited to independent
  2  2 living centers located or for proposed independent living
  2  3 centers to be located in this state which receive or are
  2  4 eligible to receive a federal grant to centers for independent
  2  5 living under 29 U.S.C. } 796f et seq.  Moneys granted under
  2  6 this section shall be used in accordance with federal
  2  7 requirements for centers for independent living.  A grantee
  2  8 providing independent living services in this and another
  2  9 state shall utilize moneys granted under this section only for
  2 10 assistance provided to residents of this state.
  2 11    4.  The division shall establish reporting requirements and
  2 12 other requirements deemed necessary by the division to ensure
  2 13 that the moneys granted under this section are used
  2 14 appropriately in accordance with federal requirements for
  2 15 centers for independent living.
  2 16    5.  The statewide independent living council shall identify
  2 17 communities that are not served by an independent living
  2 18 center by use of surveys, focus groups, or other means deemed
  2 19 appropriate by the council.  The council shall submit a report
  2 20 the governor and the general assembly by January 31, 2000.
  2 21 The report shall include findings, a listing of identified
  2 22 communities that are interested in the establishment of a
  2 23 center for independent living, and corresponding cost
  2 24 projections.
  2 25    6.  The statewide independent living council shall revise
  2 26 the state plan for independent living as necessary to reflect
  2 27 any changes needed as a result of enactment of this Act.  
  2 28                           EXPLANATION 
  2 29    This bill relates to and makes an appropriation to the
  2 30 department of education for funding of centers for independent
  2 31 living for persons with disabilities.
  2 32    The appropriation is allocated for grants to existing
  2 33 centers, for grants to establish new centers, and for a study
  2 34 to identify communities not being served by a center.
  2 35    The appropriation is to be administered by the department's
  3  1 division of vocational rehabilitation.  The grant funding is
  3  2 to be administered in accordance with a plan developed in
  3  3 consultation with the state association of independent living.
  3  4    Definitions and other requirements for centers for
  3  5 independent living are established in federal law.  The
  3  6 requirements include nonprofit status, a focus on serving
  3  7 persons with severe disabilities, control of the center by
  3  8 persons with disabilities, provision of certain core services,
  3  9 an emphasis on community-based, nonresidential services, and
  3 10 provision for equal access to services.
  3 11    The statewide independent living council, an entity created
  3 12 in accordance with federal law, is to use part of the
  3 13 appropriated funding in identifying and studying communities
  3 14 that do not have a center for independent living.  The report
  3 15 of the study is to be submitted to the governor and the
  3 16 general assembly by January 31, 2000.  The council is to
  3 17 revise the state plan for independent living to reflect any
  3 18 changes needed as result of the bill's enactment.
