1 1 Section 1. Section 306C.10, subsection 2, Code 1999, is
1 2 amended by adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. "Advertising device" does not
1 4 include a drunk driving victim memorial sign under section
1 5 306C.25.
1 6 Sec. 2. NEW SECTION. 306C.25 DRUNK DRIVING VICTIM
1 7 MEMORIAL SIGN PROGRAM.
1 8 1. The department shall establish and administer a drunk
1 9 driving victim memorial sign program. A person may apply to
1 10 the department to sponsor a drunk driving victim memorial sign
1 11 in memory of a person who died as a result of a motor vehicle
1 12 accident caused by a person who was shown to have been
1 13 operating while intoxicated in violation of section 321J.2,
1 14 subsection 1, at the time of the accident. The department
1 15 shall establish by rule, application procedures and methods
1 16 for proving eligibility for the program.
1 17 2. Drunk driving victim memorial signs and the costs of
1 18 erection of such signs shall be paid for by the sponsors. The
1 19 signs shall feature the words "Please Don't Drink and Drive"
1 20 and shall include a plaque displaying the message "In Memory
1 21 of", together with the particular victim's name. The signs
1 22 shall be placed near the scene of the accident.
1 23 3. Drunk driving victim memorial signs may be placed on
1 24 any primary road, except an interstate road, under the
1 25 jurisdiction of the department. The department shall adopt
1 26 rules pursuant to chapter 17A to administer this section.
1 27 EXPLANATION
1 28 This bill requires the state department of transportation
1 29 to establish and administer a drunk driving victim memorial
1 30 sign program. A person may sponsor a sign in memory of a
1 31 victim killed as a result of a motor vehicle accident caused
1 32 by a drunk driver. Signs may be placed on any primary road,
1 33 except an interstate road, under the jurisdiction of the
1 34 department and shall be placed near the scene of the
1 35 particular accident. The signs are to be paid for by the
2 1 sponsors.
