  1  4 ESTABLISHING A SOUTHERN IOWA DEVELOPMENT AND CONSERVATION
  1  5    AUTHORITY, SPECIFYING MEMBERSHIP, POWERS, AND DUTIES, 
  1  6    CREATING A SOUTHERN IOWA DEVELOPMENT AND CONSERVATION FUND,
  1  7    AND PROVIDING FOR OTHER PROPERLY RELATED MATTERS.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  NEW SECTION.  161D.11  SOUTHERN IOWA
  1 12 DEVELOPMENT AND CONSERVATION AUTHORITY CREATED – MEMBERSHIP
  1 13 AND DUTIES.
  1 14    1.  A southern Iowa development and conservation authority
  1 15 is created.  The counties of Appanoose, Clarke, Davis,
  1 16 Decatur, Jefferson, Lucas, Monroe, Van Buren, Wapello, and
  1 17 Wayne are entitled to one voting member each on the authority,
  1 18 but membership or participation in projects of the authority
  1 19 is not required.  Each member of the authority shall be
  1 20 appointed by the respective board of supervisors for a term to
  1 21 be determined by each board of supervisors, but the term shall
  1 22 not be for less than one year.  An appointee shall serve
  1 23 without compensation, but an appointee may be reimbursed for
  1 24 actual expenses incurred while performing the duties of the
  1 25 authority as determined by each board of supervisors.  The
  1 26 authority shall meet, organize, and adopt rules of procedures
  1 27 as deemed necessary to carry out its duties.  The authority
  1 28 may appoint working committees that include other individuals
  1 29 in addition to voting members.
  1 30    2.  The mission of the authority is to develop and
  1 31 coordinate plans for projects related to the unique natural
  1 32 resources, rural development, and infrastructure problems of
  1 33 counties in the most fragile areas of the southern Iowa drift
  1 34 plain.  The authority's mission is established in part as a
  1 35 response to the erosion of soils, degradation of water
  2  1 resources, and the destabilization of stream channels in the
  2  2 fragile glacial till soils of southern Iowa that have occurred
  2  3 in a large part due to unchecked conversion of grassland to
  2  4 cropland.  This land use conversion was brought about by the
  2  5 economic pressures of past federal agricultural policies that
  2  6 disregarded the fragile nature of the southern Iowa soil
  2  7 resource and the incompatibility of these soils with the
  2  8 subsidized commodities.  The resulting erosion of the land has
  2  9 damaged the rural infrastructure of this area, destroyed
  2 10 public roads and bridges, adversely impacted stream water
  2 11 quality and riparian habitat, affected other public and
  2 12 private improvements, and severely threatens the potable water
  2 13 supply of the region.  Reducing soil erosion, preventing
  2 14 sedimentation, and stopping nutrients and pesticides from
  2 15 entering water resources are all necessary to protect the
  2 16 rural infrastructure in the southern area of the state.
  2 17 Important protection measures include structural improvements
  2 18 and the reestablishment of grasslands for sustainable economic
  2 19 uses.
  2 20    3.  The authority shall cooperate with the division of soil
  2 21 conservation of the department of agriculture and land
  2 22 stewardship, the affected soil and water conservation
  2 23 districts, the department of natural resources, and the state
  2 24 department of transportation in carrying out its mission and
  2 25 duties.  The authority shall also cooperate with appropriate
  2 26 federal agencies, including the United States environmental
  2 27 protection agency, the United States department of interior,
  2 28 and the United States department of agriculture natural
  2 29 resources conservation service.  The authority shall make use
  2 30 of technical resources available through member counties and
  2 31 cooperating agencies.
  2 32    4.  The authority shall administer the southern Iowa
  2 33 development and conservation fund created under section
  2 34 161D.12 and shall deposit and expend moneys in the fund for
  2 35 the planning, development, and implementation of development
  3  1 and conservation activities or measures in the member
  3  2 counties.
  3  3    5.  This section is not intended to affect the authority of
  3  4 the department of natural resources in its acquisition,
  3  5 development, and management of public lands within the
  3  6 counties represented by the authority.
  3  7    Sec. 2.  NEW SECTION.  161D.12  SOUTHERN IOWA DEVELOPMENT
  3  8 AND CONSERVATION FUND.
  3  9    A southern Iowa development and conservation fund is
  3 10 created in the state treasury, to be administered by the
  3 11 southern Iowa development and conservation authority.  The
  3 12 proceeds of the fund shall be used for the purposes specified
  3 13 in section 161D.11.  The southern Iowa development and
  3 14 conservation authority may accept gifts, bequests, other
  3 15 moneys including, but not limited to, state or federal moneys,
  3 16 and in-kind contributions for deposit in the fund.  The gifts,
  3 17 grants, bequests from public and private sources, state and
  3 18 federal moneys, and other moneys received by the authority
  3 19 shall be deposited in the fund and any interest earned on
  3 20 moneys in the fund shall be credited to the fund to be used
  3 21 for the purposes specified in section 161D.11.
  3 22 Notwithstanding section 8.33, any unexpended or unencumbered
  3 23 moneys remaining in the fund at the end of the fiscal year
  3 24 shall not revert to the general fund of the state, but the
  3 25 moneys shall remain available for expenditure by the authority
  3 26 in succeeding fiscal years.
