  1  4 RELATING TO INCREASING THE PENALTY FOR ELUDING OR ATTEMPTING TO
  1  5    ELUDE AN OFFICIAL LAW ENFORCEMENT VEHICLE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 321.279, Code 1999, is amended to read
  1 10 as follows:
  1 11    321.279  ELUDING OR ATTEMPTING TO ELUDE PURSUING LAW
  1 12 ENFORCEMENT VEHICLE.
  1 13    1.  The driver of a motor vehicle commits a serious
  1 14 misdemeanor if the driver willfully fails to bring the motor
  1 15 vehicle to a stop or otherwise eludes or attempts to elude a
  1 16 marked official law enforcement vehicle driven by a uniformed
  1 17 peace officer after being given a visual or and audible signal
  1 18 to stop and in doing so exceeds the speed limit by twenty-five
  1 19 miles per hour or more.  The signal given by the peace officer
  1 20 shall be by flashing red light or and siren.  For purposes of
  1 21 this section, "peace officer" means those officers designated
  1 22 under section 801.4, subsection 11, paragraphs "a," "b," "c,"
  1 23 "g," and "h".
  1 24    2.  The driver of a motor vehicle commits an aggravated
  1 25 misdemeanor if the driver willfully fails to bring the motor
  1 26 vehicle to a stop or otherwise eludes or attempts to elude a
  1 27 marked official law enforcement vehicle that is driven by a
  1 28 uniformed peace officer after being given a visual and audible
  1 29 signal as provided in this section and in doing so exceeds the
  1 30 speed limit by twenty-five miles per hour or more.
  1 31    3.  The driver of a motor vehicle commits an aggravated
  1 32 misdemeanor a class "D" felony if, while participating in a
  1 33 public offense, as defined in section 702.13, that is a
  1 34 felony, the driver willfully fails to bring the motor vehicle
  1 35 to a stop or otherwise eludes or attempts to elude a marked
  2  1 official law enforcement vehicle that is driven by a uniformed
  2  2 peace officer after being given a visual or and audible signal
  2  3 as provided in this section, and in doing so exceeds the speed
  2  4 limit by twenty-five miles per hour or more, and if any of the
  2  5 following occurs:
  2  6    a.  The driver is participating in a public offense, as
  2  7 defined in section 702.13, that is a felony.
  2  8    b.  The driver is in violation of section 321J.2 or
  2  9 124.401.
  2 10    c.  The offense results in bodily injury to a person other
  2 11 than the driver.
