PAG LIN 1 1 Section 1. Section 558A.1, subsection 4, paragraph c, Code 1 2 1999, is amended to read as follows: 1 3 c. A transfer by a fiduciary in the course of the 1 4 administration of a decedent's estate, guardianship, 1 5 conservatorship,ortrust, or power of attorney. 1 6 Sec. 2. Section 558A.1, subsection 4, Code 1999, is 1 7 amended by adding the following new paragraph: 1 8 NEW PARAGRAPH. i. A transfer of newly constructed 1 9 residential real property which has never been occupied. 1 10 EXPLANATION 1 11 This bill amends the definition of "transfer" for purposes 1 12 of real estate disclosure requirements under Code chapter 558A 1 13 to exclude a transfer by a fiduciary in administering a power 1 14 of attorney and a transfer of newly constructed residential 1 15 real property which has never been occupied. 1 16 LSB 2036HH 78 1 17 mj/gg/8
