  1  1    Section 1.  Section 309.17, Code 1999, is amended to read
  1  2 as follows:
  1  3    309.17  ENGINEER – TERM.
  1  4    1.  The board of supervisors shall employ one or more
  1  5 registered civil engineers who shall be known as county
  1  6 engineers.  The board shall fix their term of employment which
  1  7 shall not exceed three years, but the tenure of office may be
  1  8 terminated at any time by the board.
  1  9    2.  In lieu of employing one or more registered civil
  1 10 engineers as provided in subsection 1, a board of supervisors
  1 11 may contract with a consulting engineer who shall be qualified
  1 12 as a registered civil engineer to serve as the county
  1 13 engineer.  The contract shall specify the term of retention
  1 14 which shall not exceed three years.  However, the contract may
  1 15 be renewed.
  1 16    Sec. 2.  Section 309.18, Code 1999, is amended to read as
  1 17 follows:
  1 18    309.18  COMPENSATION.
  1 19    1.  The board shall fix the compensation of the engineers.
  1 20    2.  Said The engineers shall, in the performance of their
  1 21 duties, work under the directions of said the board and shall
  1 22 give bonds for the faithful performance of their duties in a
  1 23 sum not less than two thousand nor more than five thousand
  1 24 dollars, to be approved by the board.
  1 25    3.  A contract retaining a consulting engineer shall
  1 26 specify the consulting engineer's duties, compensation, and
  1 27 amount of the performance bond which shall conform to the
  1 28 requirements of subsection 2.
  1 29    Sec. 3.  Section 309.19, Code 1999, is amended to read as
  1 30 follows:
  1 31    309.19  ADJACENT COUNTIES JOINING IN EMPLOYMENT.
  1 32    The boards of supervisors of two or more adjacent counties
  1 33 may enter into an agreement to jointly employ or retain a
  1 34 county engineer or a consulting engineer, employ professional
  1 35 and clerical assistants for the engineer, and to provide such
  2  1 services as can be carried on jointly and will operate to
  2  2 their mutual benefit.  Such The agreement shall be written and
  2  3 entered in their respective minutes.  The engineer employed or
  2  4 retained under such the agreement shall be the official county
  2  5 engineer for each of the respective boards and shall be
  2  6 employed or retained for such the term of years as shall be
  2  7 determined by the boards but in no event longer than the
  2  8 period of time the mutual agreement between the boards is to
  2  9 be in effect.  The written agreement shall provide for the
  2 10 determination of the cost of such the joint program and the
  2 11 manner of allocation of the cost to each board for inclusion
  2 12 in the respective budgets.  The boards by mutual agreement
  2 13 shall designate one board to make payments pursuant to the
  2 14 contract or for salaries and other costs of the joint program.
  2 15 The board shall be reimbursed by the other board or boards in
  2 16 accordance with the joint agreement.  The provisions of
  2 17 chapter 28E shall be applicable to this section.  
  2 18                           EXPLANATION
  2 19    This bill authorizes a county board of supervisors to
  2 20 contract with a consulting engineer to provide the services of
  2 21 a county engineer in lieu of employing one or more civil
  2 22 engineers.  The consulting engineer shall be a registered
  2 23 civil engineer and be bonded.  The contract shall provide for
  2 24 the compensation of the consulting engineer and be for a fixed
  2 25 term which shall not exceed three years.  The contract may be
  2 26 renewed.  Two or more counties may contract for the services
  2 27 of the same consulting engineer, but the counties need not be
  2 28 contiguous.
