PAG LIN 1 1 Section 1. Section 321.1, subsection 76, Code 1999, is 1 2 amended to read as follows: 1 3 76. "Special truck" means a motor truck or truck tractor 1 4 not used for hire with a gross weight registration of six 1 5 through thirty-two tons used by a person engaged in farming to 1 6 transport commodities produced only by the owner, or to 1 7 transport commodities purchased by the owner for use in the 1 8 owner's own farming operation or occasional use for charitable 1 9 purposes. "Special truck" also means a motor truck or truck 1 10 tractor not used for hire with a gross weight registration of 1 11 six through thirty-two tons used by a person engaged in 1 12 farming who assists another person engaged in farming through 1 13 an exchange of services. A "special truck" does not include a 1 14 truck tractor operated more thanseventy-five hundredfifty 1 15 thousand miles annually. 1 16 EXPLANATION 1 17 Currently, Code section 321.1 defines special trucks as 1 18 certain motor trucks and truck tractors used by persons 1 19 engaged in farming to transport commodities produced or used 1 20 by the owner or to assist another person engaged in farming. 1 21 Special trucks do not include truck tractors operated more 1 22 than 7,500 miles per year. This bill revises the definition 1 23 of a special truck to provide that a special truck does not 1 24 include a truck tractor operated more than 50,000 miles per 1 25 year. 1 26 The owner of a special truck may register the vehicle as a 1 27 special truck and pay a registration fee which is lower than 1 28 the registration fee for other trucks of similar size and 1 29 weight. Additionally, special trucks are not subject to rules 1 30 concerning periodic inspections adopted by the state 1 31 department of transportation. 1 32 LSB 1783HH 78 1 33 nh/jw/5
