PAG LIN 1 1 HOUSE CONCURRENT RESOLUTION NO. _______ 1 2 BY GRUNDBERG 1 3 A Concurrent Resolution encouraging the federal 1 4 government to provide states greater flexibility 1 5 concerning the implementation of federal legislation. 1 6 WHEREAS, the federal government has prevented 1 7 states from implementing needed federal legislation 1 8 pending the adoption of administrative regulations by 1 9 the federal executive branch and has also, at times, 1 10 failed to adopt regulations until only a few months 1 11 prior to the end of the authorization period for the 1 12 legislation; and 1 13 WHEREAS, regulations adopted at the federal level 1 14 are often cumbersome and overly prescriptive and fail 1 15 to take into account the uniqueness and ingenuity of 1 16 the several states in implementing the legislation in 1 17 a manner that fits the needs of a particular state; 1 18 and 1 19 WHEREAS, the United States Congress has 1 20 acknowledged concerns about federal regulations by 1 21 adopting the federal Congressional Review Act which 1 22 gives Congress extraordinary ability to scrutinize and 1 23 potentially expunge new regulations adopted by 1 24 executive agencies at the federal level; and 1 25 WHEREAS, Iowa has had great success when granted 1 26 the flexibility from federal regulations through 1 27 waivers to fashion solutions as evidenced by the 1 28 adoption and implementation of welfare reform through 1 29 the family investment program; and 1 30 WHEREAS, the Division of Vocational Rehabilitation 2 1 Services in the Iowa Department of Education has 2 2 generated cost savings while implementing many of the 2 3 1992 changes to the federal Vocational Rehabilitation 2 4 Act of 1973 by being granted the flexibility by the 2 5 United States Department of Education to implement the 2 6 changes without waiting for the adoption of federal 2 7 regulations; and 2 8 WHEREAS, the role of the states as laboratories of 2 9 innovation in implementing federal legislation should 2 10 be enhanced by granting states more authority and 2 11 flexibility in this area; NOW THEREFORE, 2 12 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE 2 13 SENATE CONCURRING, That the federal administration and 2 14 the United States Congress are encouraged to 2 15 investigate and adopt measures to permit states 2 16 greater flexibility in implementing and complying with 2 17 federal legislation; and 2 18 BE IT FURTHER RESOLVED, That the federal 2 19 administration and Congress consider providing states 2 20 general authority to request waivers from federal 2 21 regulations and to provide states the ability to 2 22 implement federal legislation prior to the adoption of 2 23 federal regulations concerning that legislation; and 2 24 BE IT FURTHER RESOLVED, That copies of this 2 25 resolution be sent to the President of the United 2 26 States, the President of the United States Senate, the 2 27 Speaker of the United States House of Representatives, 2 28 and the members of Iowa's congressional delegation. 2 29 LSB 2829HH 78 2 30 ec/sc/14
