1 2 #1. Page 10, by inserting after line 14, the
1 3 following:
1 4 "6. In order to promote the tobacco use prevention
1 5 and control partnership established in section 142A.1,
1 6 the following persons shall comply with the following,
1 7 as applicable:
1 8 a. A manufacturer, distributor, wholesaler,
1 9 retailer, or distributing agent or agent thereof shall
1 10 not give away cigarettes or tobacco products.
1 11 b. A manufacturer, distributor, wholesaler,
1 12 retailer, or distributing agent or agent thereof shall
1 13 not provide free articles, products, commodities,
1 14 gifts, or concessions in any exchange for the purchase
1 15 of cigarettes or tobacco products.
1 16 c. The prohibitions in this section do not apply
1 17 to transactions between manufacturers, distributors,
1 18 wholesalers, or retailers.
1 19 d. For the purpose of this subsection,
1 20 manufacturer, distributor, wholesaler, retailer, and
1 21 distributing agent mean as defined in section 453A.1."
1 22 #2. Page 13, by inserting after line 18 the
1 23 following:
1 24 "Sec. . Section 453A.39, Code 1999, is
1 25 repealed."
1 26 #3. By renumbering as necessary.
