1 2 #1. Page 1, by inserting before line 1 the
1 3 following:
1 4 "Section 1. Section 455B.482, Code 1999, is
1 5 amended by adding the following new subsection:
1 6 NEW SUBSECTION. 16. "White goods" means a major
1 7 household appliance including a refrigerator, stove,
1 8 oven, deep freeze freezer, dishwasher, clothes washer,
1 9 clothes dryer, and microwave oven.
1 10 Sec. . Section 455B.484, Code 1999, is amended
1 11 by adding the following new subsection:
1 12 NEW SUBSECTION. 15. Develop and administer the
1 13 white goods cleanup day program established in section
1 14 455B.489.
1 15 Sec. . NEW SECTION. 455B.489 WHITE GOODS
1 16 CLEANUP PROGRAM.
1 17 The waste management assistance division shall
1 18 conduct programs to collect and dispose of white
1 19 goods. The program shall be known as "white goods
1 20 cleanup days". The waste management assistance
1 21 division shall promote and conduct the program and
1 22 shall, by contracting with an approved unit of local
1 23 government, private organization or business, or
1 24 person, collect and properly dispose of white goods.
1 25 A unit of local government, private organization or
1 26 business, or person desiring to contract with the
1 27 waste management assistance division to collect and
1 28 dispose of white goods shall apply to the division for
1 29 approval. In order to be approved, the applicant must
1 30 be in compliance with all applicable state and federal
1 31 laws and administrative rules. The waste management
1 32 assistance division shall establish maximum amounts of
1 33 white goods which may be accepted from a person during
1 34 the white goods cleanup days program. Amounts
1 35 accepted from a person above the maximum shall be
1 36 limited by the waste management assistance division
1 37 and may be subject to a fee set by the division, but
1 38 the division shall not assess a fee for amounts
1 39 accepted below the maximum amount. The waste
1 40 management assistance division shall designate the
1 41 times and dates for the collection of white goods. In
1 42 order to achieve the maximum benefit from the program,
1 43 the waste management assistance division shall offer
1 44 white goods cleanup days on a statewide basis and
1 45 provide at least one white goods cleanup day in each
1 46 departmental region. White goods cleanup days shall
1 47 be offered in both rural and urban areas to provide a
1 48 comparison of response levels and to test the
1 49 viability of multicounty white goods cleanup days.
1 50 The waste management assistance division shall prepare
2 1 an annual report citing the results and costs of the
2 2 program for submittal to the general assembly."
2 3 #2. Page 1, by inserting after line 19 the
2 4 following:
2 5 "Sec. . Section 455E.11, subsection 2,
2 6 paragraph c, unnumbered paragraph 1, Code 1999, is
2 7 amended to read as follows:
2 8 A household hazardous waste account. The moneys
2 9 collected pursuant to section 455F.7 and moneys
2 10 collected pursuant to section 29C.8A which are
2 11 designated for deposit, shall be deposited in the
2 12 household hazardous waste account. Two thousand
2 13 dollars is appropriated annually to the Iowa
2 14 department of public health to carry out departmental
2 15 duties under section 135.11, subsections 20 and 21,
2 16 and section 139.35. The remainder of the account
2 17 shall be used to fund toxic cleanup days, white goods
2 18 cleanup days, and the efforts of the department to
2 19 support a collection system for household hazardous
2 20 materials and white goods, including public education
2 21 programs, training, and consultation of local
2 22 governments in the establishment and operation of
2 23 permanent collection systems, and the management of
2 24 collection sites, education programs, and other
2 25 activities pursuant to chapter 455F, including the
2 26 administration of the household hazardous materials
2 27 permit program by the department of revenue and
2 28 finance."
2 29 #3. Title page, line 1, by inserting after the
2 30 words "An Act" the following: "establishing and
2 31 funding a white goods cleanup program and".
