PAG LIN 1 1 Amend House File 2121 as follows: 1 2 #1. Page 1, by inserting before line 1 the 1 3 following: 1 4 "Section 1. Section 321.341, unnumbered paragraph 1 5 2, Code 1999, is amended to read as follows: 1 6 The driver of a vehicle shall stop and remain 1 7 standing and not traverse such a grade crossing when a 1 8 crossing gate is lowered or when a human flagman gives 1 9 or continues to give a signal of the approach or 1 10 passage of a train. This prohibition on traversing a 1 11 grade cross does not apply if a lowered crossing gate 1 12 is malfunctioning and a train is not approaching the 1 13 grade crossing. 1 14 Sec. . Section 321.344, unnumbered paragraph 4, 1 15 Code 1999, is amended to read as follows: 1 16No suchSuch a crossing shall not be made when 1 17 warning is given by automatic signal or crossing gates 1 18 or a flagman or otherwise of the immediate approach of 1 19 a railroad train or car. This prohibition on 1 20 traversing a grade crossing does not apply if an 1 21 automatic signal or crossing gate is malfunctioning 1 22 and a train is not approaching the grade crossing." 1 23 #2.
