  1  1    Amend the amendment, H-1166, to Senate File 187, as
  1  2 passed by the Senate, as follows:
  1  3    #1.  Page 1, by striking lines 22 through 29 and
  1  4 inserting the following:
  1  5    "#   .  By striking page 3, line 8, through page 4,
  1  6 line 14, and inserting the following:
  1  7    "6.  a.  Except as provided in paragraph b, an
  1  8 owner or operator of any vessel propelled by a motor
  1  9 of more than ten horsepower, including an owner of a
  1 10 boat livery, shall not permit any person under twelve
  1 11 years of age to operate the vessel unless accompanied
  1 12 in or on the same vessel by a responsible person of at
  1 13 least eighteen years of age.  However, commencing
  1 14 January 1, 2002, a person who is twelve years of age
  1 15 or older but less than eighteen years of age shall not
  1 16 operate any vessel propelled by a motor of more than
  1 17 ten horsepower unless the person has successfully
  1 18 completed an approved watercraft safety course and has
  1 19 a watercraft safety certificate in immediate
  1 20 possession or is accompanied in or on the same vessel
  1 21 by a responsible person of at least eighteen years of
  1 22 age.
  1 23    b.  An owner or operator of any personal watercraft
  1 24 propelled by a motor of more than ten horsepower,
  1 25 including an owner of a boat livery, shall not permit
  1 26 any person under fourteen years of age to operate the
  1 27 personal watercraft unless accompanied in or on the
  1 28 same personal watercraft by a responsible person of at
  1 29 least eighteen years of age.  However, commencing
  1 30 January 1, 2002, a person who is fourteen years of age
  1 31 or older but less than eighteen years of age shall not
  1 32 operate any personal watercraft propelled by a motor
  1 33 of more than ten horsepower unless the person has
  1 34 successfully completed an approved watercraft safety
  1 35 course and has a watercraft safety certificate in
  1 36 immediate possession or is accompanied in or on the
  1 37 same personal watercraft by a responsible person of at
  1 38 least eighteen years of age.
  1 39    c.  Watercraft safety certificates from an approved
  1 40 course in another state or foreign nation will meet
  1 41 the requirements of this section.  A person required
  1 42 to have a watercraft safety certificate shall carry
  1 43 and shall exhibit the certificate upon request of an
  1 44 officer of the department.
  1 45    d.  A violation of this subsection is a simple
  1 46 misdemeanor as provided in section 462A.13.""
