  1  1    Section 1.  NEW SECTION.  708.3B  INMATE ASSAULTS -- BODILY
  1  2 FLUIDS OR SECRETIONS.
  1  3    1.  A person who, while confined in an institution or
  1  4 facility under the control of the department of corrections,
  1  5 commits any of the following acts is guilty of a class "D"
  1  6 felony:
  1  7    a.  An assault, as defined under section 708.1, which
  1  8 results in contact with bodily fluids or secretions.
  1  9    b.  An act which results in bodily fluids or secretions
  1 10 being cast or expelled upon another person.
  1 11    2.  A violation of this section is a crime committed while
  1 12 confined in a detention facility or penal institution for
  1 13 purposes of section 901.8, and the sentence for violation of
  1 14 this section shall begin at the expiration of any existing
  1 15 sentence that the person is serving.  
  1 16                              EXPLANATION
  1 17    This bill provides that assaults by persons who are
  1 18 confined in institutions or facilities under the control of
  1 19 the department of corrections which result in contact with
  1 20 bodily fluids or secretions or acts which result in bodily
  1 21 fluids or secretions being cast or expelled upon another
  1 22 person are class "D" felonies.  Persons convicted of class "D"
  1 23 felonies must be confined for no more than five years and may
  1 24 be sentenced to a fine of at least $500, but not more than
  1 25 $7,500.  The sentence imposed for a violation of the new
  1 26 provision must also run consecutively to any sentence that the
  1 27 person is serving.
