1 1 Section 1. NEW SECTION. 602.6204 APPOINTMENT OF DISTRICT
1 2 JUDGE IN LIEU OF DISTRICT ASSOCIATE JUDGE.
1 3 1. Notwithstanding section 602.6201, if a vacancy occurs
1 4 in the office of district associate judge and replacement of
1 5 the district associate judge is authorized pursuant to section
1 6 602.6301 or 602.6302, in lieu of the nomination and
1 7 appointment of a district associate judge, a district judge
1 8 shall be nominated and appointed pursuant to the requirements
1 9 of chapter 46 and subject to the requirements of this section.
1 10 2. A district judge appointed pursuant to this section
1 11 shall be deemed a district associate judge for purposes of
1 12 apportionment of the judge pursuant to section 602.6301.
1 13 3. If a vacancy occurs in the office of a district judge
1 14 appointed pursuant to this section, a district judge shall be
1 15 appointed if a district associate judge would be authorized to
1 16 be appointed pursuant to section 602.6301, notwithstanding the
1 17 requirements of section 602.6201.
1 18 4. A district judge appointed pursuant to this section
1 19 shall stand for retention in office as a district judge as
1 20 provided in chapter 46.
1 21 EXPLANATION
1 22 This bill provides that district associate judge vacancies
1 23 shall be filled with a district judge if replacement of the
1 24 district associate judge is otherwise authorized pursuant to
1 25 the population-based formula of section 602.6301 or section
1 26 602.6302. Replacement of a district judge appointed pursuant
1 27 to this new section will be based on the formula concerning
1 28 district associate judges and not based on the formula and
1 29 limitations on district judges as provided in section
1 30 602.6201.
