  1  4 RELATING TO DEBT COLLECTION.
  1  5 
  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  7 
  1  8    Section 1.  Section 537.7103, subsection 4, paragraph b,
  1  9 Code Supplement 1997, is amended to read as follows:
  1 10    b.  The failure to disclose in the initial written
  1 11 communication with the debtor and, in addition, if the initial
  1 12 communication with the debtor is oral, in that initial oral
  1 13 communication, that the debt collector is attempting to
  1 14 collect a debt and that information obtained will be used for
  1 15 that purpose, and the failure to disclose in subsequent
  1 16 communications that the communication is from a debt
  1 17 collector, except that this paragraph does not apply to a
  1 18 either of the following:
  1 19    (1)  A formal pleading made in connection with a legal
  1 20 action.
  1 21    (2)  Communications issued directly by a state bank as
  1 22 defined in section 524.103, a state bank chartered under the
  1 23 laws of any other state, a national banking association, a
  1 24 trust company, a federally chartered savings and loan
  1 25 association or savings bank, an out-of-state chartered savings
  1 26 and loan association or savings bank, a financial institution
  1 27 chartered by the federal home loan bank board, an association
  1 28 incorporated or authorized to do business under chapter 534, a
  1 29 state or federally chartered credit union, or a company or
  1 30 association organized or authorized to do business under
  1 31 chapter 515, 518, 518A, or 520, or an officer, employee, or
  1 32 agent of such company or association, provided the
  1 33 communication does not deceptively conceal its origin or its
  1 34 purpose.
