  1  4 RELATING TO AGRICULTURE BY AMENDING AND ELIMINATING PROVISIONS
  1  5    TO REFLECT CURRENT PRACTICES, AND TRANSFERRING PROVISIONS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 159.6, subsection 7, Code 1997, is
  1 10 amended by striking the subsection.
  1 11    Sec. 2.  Section 159.6, subsection 9, Code 1997, is amended
  1 12 to read as follows:
  1 13    9.  State aid received by certain associations as provided
  1 14 in chapters 176 through 183 182, 186, and 352.
  1 15    Sec. 3.  Section 159.20, subsection 5, Code 1997, is
  1 16 amended to read as follows:
  1 17    5.  Accumulate and diffuse information concerning the
  1 18 marketing of agricultural commodities in cooperation with
  1 19 persons, agencies, or the federal government.  The department
  1 20 shall establish an agricultural commodity informational data
  1 21 base.
  1 22    Sec. 4.  Section 172A.6, unnumbered paragraph 1, Code 1997,
  1 23 is amended to read as follows:
  1 24    The license and financial responsibility provisions of this
  1 25 chapter shall not apply to any person who is licensed by the
  1 26 secretary as provided in chapter 137A, 171 or 172 and who
  1 27 purchases livestock for slaughter valued at less than an
  1 28 average daily value of two thousand five hundred dollars
  1 29 during the preceding twelve months or such part thereof as the
  1 30 person was purchasing livestock. Said licensees are made
  1 31 subject to this chapter as to the regulatory and penal
  1 32 provisions hereof. All other provisions of this chapter shall
  1 33 apply to said dealers or brokers.
  1 34    Sec. 5.  Section 173.3, Code 1997, is amended to read as
  1 35 follows:
  2  1    173.3  CERTIFICATION OF STATE AID ASSOCIATIONS.
  2  2    On or before November 15 of each year, the secretary of
  2  3 agriculture shall certify to the secretary of the state fair
  2  4 board the names of the various associations and societies
  2  5 which have qualified for state aid under the provisions of
  2  6 chapters 176 through 178, 180 through 183 181, 182, 186, and
  2  7 352, and which are entitled to representation in the
  2  8 convention as provided in section 173.2.
  2  9    Sec. 6.  Section 190.2, unnumbered paragraph 1, Code 1997,
  2 10 is amended to read as follows:
  2 11    The department may establish and publish standards for
  2 12 foods when such standards are not fixed by law, but the same.
  2 13 The standards shall conform with those proclaimed standards
  2 14 for foods adopted by the secretary of agriculture of federal
  2 15 agencies including, but not limited to, the United States
  2 16 department of agriculture.
  2 17    Sec. 7.  Section 198.9, subsection 3, unnumbered paragraph
  2 18 3, Code 1997, is amended by striking the paragraph.
  2 19    Sec. 8.  Section 331.507, subsection 3, Code 1997, is
  2 20 amended by striking the subsection.
  2 21    Sec. 9.  Chapters 171, 180, 183, and 190A, Code 1997, are
  2 22 repealed.
  2 23    Sec. 10.  Sections 159.12, 159.18, 159.34, 160.11, 160.16,
  2 24 172.5, 213.4, 213.5, 213.6, and 352.13, Code 1997, are
  2 25 repealed.
  2 26    Sec. 11.  DIRECTIONS TO THE CODE EDITOR.  The Code editor
  2 27 shall transfer the provisions of chapter 196A to or near
  2 28 chapter 184.
