PAG LIN 1 1 SENATE FILE 2109 1 2 1 3 AN ACT 1 4 RELATING TO MOBILE HOME DEALERS. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 322B.2, subsections 3 and 4, Code 1997, 1 9 are amended by striking the subsections. 1 10 Sec. 2. Section 322B.2, subsections 5 and 7, Code 1997, 1 11 are amended to read as follows: 1 12 5. "Mobile home" means a structure, transportable in one 1 13 or more sections, which exceeds eight feet in width and 1 14 thirty-two feet in length, and which is built on a permanent 1 15 chassis and designed to be used as a dwelling with or without 1 16 a permanent foundation when connected to one or more 1 17 utilities. "Mobile home" also includes "manufactured home" as 1 18 the term is defined in section 435.1. 1 19 7. "Mobile home distributor" means a person who sells or 1 20 distributes mobile homes to mobile home dealerseither1 21directly or through a distributor's representative. 1 22 Sec. 3. Section 322B.3, subsection 3, Code 1997, is 1 23 amended to read as follows: 1 24 3. SURETY BOND. Before the issuance of a mobile home 1 25 dealer's license, an applicant for a license shall file with 1 26 the department a surety bond executed by the applicant as 1 27 principal and executed by a corporate surety company, licensed 1 28 and qualified to do business within this state, which bond 1 29 shall run to the state of Iowa, be in the amount oftwenty-1 30fivefifty thousand dollars and be conditioned upon the 1 31 faithful compliance by the applicant as a dealer with all of 1 32 the statutes of this state regulating the business of the 1 33 dealer and indemnifying any person dealing or transacting 1 34 business with the dealer in connection with a mobile home from 1 35 a loss or damage occasioned by the failure of the dealer to 2 1 comply with this chapter, including, but not limited to, the 2 2 furnishing of a proper and valid document of title to the 2 3 mobile home involved in the transaction. 2 4 Sec. 4. Section 322B.3, Code 1997, is amended by adding 2 5 the following new subsection: 2 6 NEW SUBSECTION. 5. MOBILE HOME HOOKUPS. A mobile home 2 7 dealer or an employee of a mobile home dealer may perform 2 8 water, gas, electrical, and other utility service connections 2 9 in a mobile home, space or within ten feet of such space, 2 10 located in a mobile home park, and the dealer or an employee 2 11 of the dealer may install a tie-down system on a mobile home 2 12 located in a mobile home park. The connections are subject to 2 13 inspection and approval by local building code officials and 2 14 the mobile home dealer shall pay the inspection fee, if any. 2 15 Sec. 5. Section 322B.4, subsection 2, Code 1997, is 2 16 amended by striking the subsection. 2 17 Sec. 6. Section 322B.6, unnumbered paragraph 1, Code 1997, 2 18 is amended to read as follows: 2 19 The department may revoke, suspend, or refuse the license 2 20 of a mobile home dealer, mobile home manufacturer, or mobile 2 21 home distributor,manufacturer's representative, or2 22distributor's representative,as applicable, if the department 2 23 finds that the mobile home dealer, manufacturer, or 2 24 distributor, or representativeis guilty of any of the 2 25 following acts or offenses: 2 26 Sec. 7. Section 322B.6, subsections 2 and 3, Code 1997, 2 27 are amended to read as follows: 2 28 2. Knowingly making misleading, deceptive, untrue or 2 29 fraudulent representations in the business of a mobile home 2 30 dealer, manufacturer, or distributor, manufacturer's2 31representative or distributor's representativeor engaging in 2 32 unethical conduct or practice harmful or detrimental to the 2 33 public. 2 34 3. Conviction of a felony related to the business of a 2 35 mobile home dealer, manufacturer, or distributor,3 1manufacturer's representative or distributor's representative. 3 2 A copy of the record of conviction or plea of guilty shall be 3 3 sufficient evidence for the purposes of this section. 3 4 Sec. 8. Section 322B.6, subsection 6, Code 1997, is 3 5 amended by striking the subsection. 3 6 Sec. 9. Section 322B.8, Code 1997, is amended to read as 3 7 follows: 3 8 322B.8 UNLAWFUL PRACTICE. 3 9 It is unlawful for a person to engage in business as a 3 10 mobile home dealer, mobile home manufacturer, or mobile home 3 11 distributor, manufacturer's representative or distributor's3 12representativein this state without first acquiring and 3 13 maintaining a license in accordance with this chapter.
