  1  4 RELATING TO THE RESPONSIBILITIES OF THE DEPARTMENT OF
  1  5    TRANSPORTATION, INCLUDING VEHICLE EQUIPMENT AND 
  1  6    PARKING REGULATION, POSTINGS OF HIGHWAY WEIGHT 
  1  7    RESTRICTIONS, AND RECEIPT OF PLANS FOR CITY STREET 
  1  8    CONSTRUCTION.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 11 
  1 12    Section 1.  Section 312.15, Code 1997, is amended to read
  1 13 as follows:
  1 14    312.15  WHEN FUNDS NOT ALLOCATED.
  1 15    Funds shall not be allocated to any city until such city
  1 16 shall have complied with the provisions of sections 312.11,
  1 17 312.12 and 312.14.
  1 18    If a city has not complied with the provisions of section
  1 19 312.14, the treasurer of state shall withhold funds allocated
  1 20 to the city until the city complies.  If a city has not
  1 21 complied with the provisions of section 312.14 by December 31
  1 22 following the date the report was required, funds shall not be
  1 23 allocated to the city until the city has complied and all
  1 24 funds withheld under this paragraph shall revert to the street
  1 25 construction fund of the cities.
  1 26    The department shall notify the treasurer of state if any
  1 27 city fails to comply with the provisions of sections 312.11,
  1 28 312.12 and 312.14.
  1 29    Sec. 2.  Section 321.231, subsection 4, Code Supplement
  1 30 1997, is amended to read as follows:
  1 31    4.  The exemptions granted to an authorized emergency
  1 32 vehicle under subsection 2 and for a fire department vehicle,
  1 33 police vehicle or ambulance as provided in subsection 3 shall
  1 34 apply only when such vehicle is making use of an audible
  1 35 signaling device meeting the requirements of section 321.433,
  2  1 or a visual signaling device, approved by the department
  2  2 except that use of an audible or visual signaling device shall
  2  3 not be required when exercising the exemption granted under
  2  4 subsection 3, paragraph "b" of this section when the vehicle
  2  5 is operated by a peace officer, pursuing a suspected violator
  2  6 of the speed restrictions imposed by or pursuant to this
  2  7 chapter, for the purpose of determining the speed of travel of
  2  8 such suspected violator.
  2  9    Sec. 3.  Section 321.383, subsection 3, unnumbered
  2 10 paragraph 1, Code Supplement 1997, is amended to read as
  2 11 follows:
  2 12    Garbage collection vehicles, when operated on the streets
  2 13 or highways of this state at speeds of thirty miles per hour
  2 14 or less, may display a reflective device of a type and in a
  2 15 manner approved by the director that complies with the
  2 16 standards of the American society of agricultural engineers.
  2 17 At speeds in excess of thirty miles per hour the device shall
  2 18 not be visible.
  2 19    Sec. 4.  Section 321.433, Code 1997, is amended to read as
  2 20 follows:
  2 21    321.433  SIRENS, WHISTLES, AND BELLS PROHIBITED.
  2 22    No A vehicle shall not be equipped with nor shall any and a
  2 23 person shall not use upon a vehicle any siren, whistle, or
  2 24 bell, except as otherwise permitted in this section.  It is
  2 25 permissible but not required that any commercial vehicle be
  2 26 equipped with a theft alarm signal device which is so arranged
  2 27 that it cannot be used by the driver as an ordinary warning
  2 28 signal.  Any authorized emergency vehicle may be equipped with
  2 29 a siren, whistle, or bell, capable of emitting sound audible
  2 30 under normal conditions from a distance of not less than five
  2 31 hundred feet and of a type approved by the department, but
  2 32 such the siren, whistle, or bell shall not be used except when
  2 33 such the vehicle is operated in response to an emergency call
  2 34 or in the immediate pursuit of an actual or suspected violator
  2 35 of the law, in which said latter events and the driver of such
  3  1 the vehicle shall sound said the siren, whistle, or bell when
  3  2 necessary to warn pedestrians and other drivers of the
  3  3 approach thereof of the vehicle.
  3  4    Sec. 5.  Section 321.444, subsection 2, Code Supplement
  3  5 1997, is amended to read as follows:
  3  6    2.  The term "safety "Safety glass" shall mean means any
  3  7 product composed of glass, so manufactured, fabricated, or
  3  8 treated as substantially to prevent shattering and flying of
  3  9 the glass when struck or broken or such other or similar
  3 10 product as may be approved by the director.  Safety glass and
  3 11 glazing materials shall comply with federal motor vehicle
  3 12 safety standard number 205 as published in 49 C.F.R. }
  3 13 571.205.
  3 14    Sec. 6.  Section 321.445, subsection 1, Code Supplement
  3 15 1997, is amended to read as follows:
  3 16    1.  Except for motorcycles or motorized bicycles, 1966
  3 17 model year or newer motor vehicles subject to registration in
  3 18 Iowa shall be equipped with safety belts and safety harnesses
  3 19 which conform with federal motor vehicle safety standard
  3 20 numbers 209 and 210 as published in 49 C.F.R. } 571.209-
  3 21 571.210 and with prior federal motor vehicle safety standards
  3 22 for seat belt assemblies and seat belt assembly anchorages
  3 23 applicable for the motor vehicle's model year.  The department
  3 24 may adopt rules which comply with changes in the applicable
  3 25 federal motor vehicle safety standards with regard to the type
  3 26 of safety belts and safety harnesses and their manner of
  3 27 installation.
  3 28    Sec. 7.  Section 321.445, subsection 2, paragraph a, Code
  3 29 Supplement 1997, is amended to read as follows:
  3 30    a.  The driver or front seat occupants of a motor vehicle
  3 31 which is not required to be equipped with safety belts or
  3 32 safety harnesses under rules adopted by the department.
  3 33    Sec. 8.  Section 321G.12, Code 1997, is amended to read as
  3 34 follows:
  3 35    321G.12  HEAD LAMP – TAIL LAMP – BRAKES.
  4  1    Every all-terrain vehicle operated during the hours of
  4  2 darkness shall display a lighted head lamp and tail lamp.
  4  3 Every snowmobile shall be equipped with at least one head lamp
  4  4 and one tail lamp.  Every all-terrain vehicle and snowmobile
  4  5 shall be equipped with brakes which conform to standards
  4  6 prescribed by the director of transportation.
  4  7    Sec. 9.  Section 321L.2A, Code Supplement 1997, is amended
  4  8 to read as follows:
  4  9    321L.2A  WHEELCHAIR LIFT WARNING PARKING CONE.
  4 10    The department shall, upon the request of a person issued a
  4 11 persons with disabilities parking permit under section 321L.2
  4 12 who operates a motor vehicle with uses a wheelchair lift,
  4 13 shall provide the person with a traffic cone list of names and
  4 14 addresses of vendors who sell parking cones bearing the
  4 15 international symbol of accessibility and the words
  4 16 "wheelchair lift parking space".  The department shall adopt
  4 17 rules as necessary to implement administer this section.
  4 18    Sec. 10.  Section 321L.5, subsection 5, Code Supplement
  4 19 1997, is amended to read as follows:
  4 20    5.  A persons with disabilities parking space located on a
  4 21 paved surface may be painted with a blue background upon which
  4 22 the international symbol of accessibility is painted in white
  4 23 or yellow nonskid paint.  However, the blue background paint
  4 24 may be omitted.  As used in this subsection, "paved surface"
  4 25 includes surfaces which are asphalt surfaced.
  4 26    Sec. 11.  Section 312.12, Code 1997, is repealed.
