PAG LIN 1 1 Section 1. NEW SECTION. 297A.1 SCHOOL INFRASTRUCTURE 1 2 FUND APPROPRIATION. 1 3 1. There is appropriated annually from the general fund of 1 4 the state to the department of education the sum of one 1 5 hundred million dollars to establish, maintain, and administer 1 6 a school infrastructure fund. 1 7 2. Moneys appropriated in subsection 1 shall be allocated 1 8 to school districts throughout the state on a per pupil basis. 1 9 The amount of moneys allocated to school districts shall be in 1 10 the proportion that the basic enrollment of a district bears 1 11 to the sum of the basic enrollments of all school districts in 1 12 the state for the budget year. 1 13 3. The department of management shall allocate to each 1 14 school district the amount calculated pursuant to subsection 2 1 15 in one payment on or about October 15 annually, based upon the 1 16 actual enrollment certified to the department of education for 1 17 each school district and forwarded to the department of 1 18 management, taking into consideration the relative budget and 1 19 cash position of the state resources. By October 1 annually, 1 20 prior to the receipt of funds, school districts shall submit 1 21 to the department of education a school infrastructure 1 22 progress report. The report shall provide adequate assurance 1 23 that the school district has developed or is developing a 1 24 school infrastructure plan containing an analysis of school 1 25 district infrastructure needs, priorities, and an estimated 1 26 timetable for completion of infrastructure projects or 1 27 allocation of funds previously received by the school district 1 28 pursuant to subsection 2. 1 29 4. Moneys received under this section shall not be 1 30 commingled with state aid payments made under section 257.16 1 31 to a school district, and shall be accounted for by the school 1 32 district separately from state aid payments. Payments made to 1 33 school districts pursuant to this section are miscellaneous 1 34 income for purposes of chapter 257 or are considered 1 35 encumbered. Each school district shall maintain a separate 2 1 listing within its budget for payments received and 2 2 expenditures made pursuant to this section. Moneys received 2 3 under this section shall not be used for payment of any 2 4 collective bargaining agreement or arbitrator's decision 2 5 negotiated or awarded under chapter 20. 2 6 5. For purposes of this chapter, a "school district" shall 2 7 mean a school district as defined in section 257.2. 2 8 Sec. 2. NEW SECTION. 297A.2 SCHOOL INFRASTRUCTURE 2 9 EXPENDITURES. 2 10 1. School districts shall expend funds received pursuant 2 11 to section 297A.1 for school infrastructure needs. For 2 12 purposes of this chapter, "school infrastructure" includes the 2 13 following: 2 14 a. Activities for which a school district is authorized to 2 15 contract indebtedness and issue general obligation bonds under 2 16 section 296.1, except those activities related to a teacher's 2 17 or superintendent's home or homes. These activities include 2 18 the construction, reconstruction, repair, purchasing, or 2 19 remodeling of schoolhouses, stadiums, gyms, fieldhouses, and 2 20 bus garages. 2 21 b. Procurement of school house construction sites and the 2 22 making of site improvements. 2 23 c. Payment or retirement of outstanding bonds previously 2 24 issued for school infrastructure purposes, as defined in this 2 25 subsection, if it is determined by the department of education 2 26 that the school district has undertaken a serious effort to 2 27 meet its school infrastructure needs. In making this 2 28 determination, the department shall consider the relative size 2 29 and property tax base of the school district, and the 2 30 information provided to the department in the school 2 31 district's infrastructure progress report pursuant to section 2 32 297A.1. 2 33 d. Maintenance of schoolhouses and school district 2 34 property. 2 35 e. School improvement technology programs pursuant to 3 1 chapter 295, utilized for a school district. 3 2 2. Funds received by a school district pursuant to this 3 3 chapter shall not be expended to add a full-time equivalent 3 4 position or otherwise increase staffing. 3 5 EXPLANATION 3 6 This bill provides for the creation of a school 3 7 infrastructure fund established, maintained, and administered 3 8 by the department of education, and appropriates annually from 3 9 the general fund of the state to the department the sum of 3 10 $100 million to be allocated to a school districts for school 3 11 infrastructure purposes. The amount of moneys allocated to 3 12 school district shall be in the proportion that the basic 3 13 enrollment of the district bears to the sum of the basic 3 14 enrollments of all school districts in the state for the 3 15 budget year. The allocation shall be made to school districts 3 16 by the department of management in one payment on or about 3 17 October 15 annually, based upon the actual enrollment 3 18 certified to the department of education for each school 3 19 district, taking into consideration the relative budget and 3 20 cash position of the state resources. 3 21 Prior to the receipt of funds, by October 1 annually, 3 22 school districts shall submit to the department of education a 3 23 school infrastructure progress report providing adequate 3 24 assurance that the school district has developed or is 3 25 developing a school infrastructure plan containing an analysis 3 26 of school district infrastructure needs, priorities, and an 3 27 estimated timetable for completion of infrastructure projects 3 28 or allocation of funds received by the school district. 3 29 The bill provides that school districts shall expend the 3 30 appropriated funds for school infrastructure needs, which are 3 31 defined to include the construction, reconstruction, repair, 3 32 purchasing, or remodeling of schoolhouses, stadiums, gyms, 3 33 fieldhouses, and bus garages; the procurement of school house 3 34 construction sites and the making of site improvements; and 3 35 the payment or retirement of outstanding bonds previously 4 1 issued for school infrastructure purposes if the department of 4 2 education determines that the school district has made a 4 3 significant effort in meeting its infrastructure needs. 4 4 Additionally, school infrastructure includes the maintenance 4 5 of schoolhouses and school district property, and school 4 6 improvement technology programs pursuant to chapter 295. 4 7 LSB 3460XS 77 4 8 rn/jl/8
