  1  5 RELATING TO THE CREATION OF A DENTAL HYGIENE
  1  6    COMMITTEE WITHIN THE BOARD OF DENTAL EXAMINERS.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 147.14, subsection 4, Code 1997, is
  1 11 amended to read as follows:
  1 12    4.  For dental examiners, five members shall be licensed to
  1 13 practice dentistry, two members shall be licensed to practice
  1 14 dental hygiene and two members not licensed to practice
  1 15 dentistry or dental hygiene and who shall represent the
  1 16 general public.  A majority of the members of the board shall
  1 17 constitute a quorum.  No member of the dental faculty of the
  1 18 school of dentistry at the state University of Iowa shall be
  1 19 eligible to be appointed.  Beginning January 1, 2000, persons
  1 20 appointed to the board as dental hygienist members shall not
  1 21 be employed by or receive any form of remuneration from a
  1 22 dental or dental hygiene educational institution.  The two
  1 23 dental hygienist board members and one dentist board member
  1 24 shall constitute a dental hygiene committee of the board as
  1 25 provided in section 153.33A.
  1 26    Sec. 2.  NEW SECTION.  153.33A  DENTAL HYGIENE COMMITTEE.
  1 27    1.  A three-member dental hygiene committee of the board of
  1 28 dental examiners is created, consisting of the two dental
  1 29 hygienist members of the board and one dentist member of the
  1 30 board.  The dentist member of the committee must have
  1 31 supervised and worked in collaboration with a dental hygienist
  1 32 for a period of at least three years immediately preceding
  1 33 election to the committee.  The dentist member shall be
  1 34 elected to the committee annually by a majority vote of board
  1 35 members.
  2  1    2.  The committee shall have the authority to adopt
  2  2 recommendations regarding the practice, discipline, education,
  2  3 examination, and licensure of dental hygienists, subject to
  2  4 subsection 3, and shall carry out duties as assigned by the
  2  5 board.  The committee shall have no regulatory or disciplinary
  2  6 authority with regard to dentists, dental assistants, dental
  2  7 lab technicians, or any other auxiliary dental personnel.
  2  8    3.  The board shall ratify recommendations of the committee
  2  9 at the first meeting of the board following adoption of the
  2 10 recommendations by the committee, or at a meeting of the board
  2 11 specifically called for the purpose of board review and
  2 12 ratification of committee recommendations.  The board shall
  2 13 decline to ratify committee recommendations only if the board
  2 14 makes a specific finding that a recommendation exceeds the
  2 15 jurisdiction or expands the scope of the committee beyond the
  2 16 authority granted in subsection 2, creates an undue financial
  2 17 impact on the board, or is not supported by the record.  The
  2 18 board shall pay the necessary expenses of the committee and of
  2 19 the board in implementing committee recommendations ratified
  2 20 by the board.
  2 21    4.  This section shall not be construed as impacting or
  2 22 changing the scope of practice of the profession of dental
  2 23 hygiene or authorizing the independent practice of dental
  2 24 hygiene.
