  1  4 RELATING TO THE AUTHORITY OF THE STATE TRANSPORTATION COM-
  1  5    MISSION TO TEMPORARILY TRANSFER REVITALIZE IOWA'S SOUND
  1  6    ECONOMY (RISE) FUNDS TO THE PRIMARY ROAD FUND AND PROVID-
  1  7    ING AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1 11    Section 1.  Section 315.3, subsection 3, Code 1997, is
  1 12 amended to read as follows:
  1 13    3.  The If the state transportation commission receives and
  1 14 files a letter from the director of transportation certifying
  1 15 that federal funding is not forthcoming due to the failure of
  1 16 the United States Congress to pass and the president of the
  1 17 United States to approve legislation providing long-term
  1 18 federal transportation funding to the state of Iowa, the
  1 19 commission may authorize the temporary transfer of funds
  1 20 between the department's share of from the RISE fund under
  1 21 section 315.4 and to the primary road fund in an amount not to
  1 22 exceed forty million dollars at one time.  Transferred funds
  1 23 shall be repaid not later than July 1, 1993 to the RISE fund
  1 24 within three months of transfer.  The commission shall manage
  1 25 the RISE fund to ensure that funds will be available to meet
  1 26 contract obligations on approved RISE projects.
  1 27    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 28 immediate importance, takes effect upon enactment.
