PAG LIN 1 1 Section 1. NEW SECTION. 123.56A MANUFACTURE OF BEER FOR 1 2 PERSONAL OR FAMILY USE – EXEMPTION. 1 3 1. A person who is not prohibited from possessing 1 4 alcoholic beverages and who manufactures beer in the person's 1 5 residence for personal or family use, and not for sale, in the 1 6 amounts provided in this section shall be exempt from the 1 7 requirements of this chapter governing the manufacture and 1 8 sale of beer. 1 9 2. The aggregate amount of beer permitted to be 1 10 manufactured with respect to any person's residence shall be 1 11 as follows: 1 12 a. An amount not in excess of two hundred gallons per 1 13 calendar year if there are two or more persons not prohibited 1 14 from possessing alcoholic beverages in the residence. 1 15 b. An amount not in excess of one hundred gallons per 1 16 calendar year if there is only one person not prohibited from 1 17 possessing alcoholic beverages in the residence. 1 18 3. Any personal or family manufacture of beer in excess of 1 19 the amounts permitted in this section or any sale of such beer 1 20 shall not be exempt from the requirements of this chapter 1 21 governing the manufacture and sale of beer. 1 22 4. Beer manufactured under the provisions of this section 1 23 may be removed from the premises where made for personal or 1 24 family use, including use at organized affairs, exhibitions, 1 25 or competitions. Beer used as provided in this subsection 1 26 shall not be sold or offered for sale. 1 27 EXPLANATION 1 28 This bill provides an exemption from the requirements of 1 29 chapter 123 governing alcoholic beverages concerning beer 1 30 manufactured for personal or family use and not for sale. The 1 31 bill provides for limits on the total amount of beer that can 1 32 be brewed at a person's residence based upon the number of 1 33 persons in the residence permitted to possess alcohol. The 1 34 bill provides that a person is not exempt from the 1 35 requirements of chapter 123 if the person brews beer in an 2 1 amount that exceeds the limits specified in the bill. The 2 2 bill also provides that the beer can be removed from the place 2 3 of manufacture for personal or family use, including use at 2 4 organized exhibitions or competitions. 2 5 LSB 2471XS 77 2 6 ec/jj/8
