PAG LIN 1 1 Section 1. Section 176A.14, subsection 4, unnumbered 1 2 paragraph 2, Code 1997, is amended to read as follows: 1 3 5. Each of the officers of the extension council shall 1 4 perform and carry out the officer's dutieshereinas provided 1 5 in this sectionimposed upon themand shall perform and carry 1 6 outsuchany other duties asshall be imposed upon them in the1 7 required by rules adopted by the extension councilfrom time1 8to timeas authorized in this chapterauthorized.The members1 9 A member of the extension council, within fifteen days after 1 10theirthe member's electionas such, shall take and sign the 1 11 usual oath of public officersand the samewhich shall be 1 12 filed in the office of the county auditor of the county of the 1 13 extension district. The treasurer of the extension council, 1 14 within ten days afterthe election as treasurerbeing elected 1 15 and before entering upon the duties of the officeas1 16treasurer, shall execute to the extension council a corporate 1 17 surety bondof one hundred twenty-five percent of thefor an 1 18 amount, as near as can be ascertained, that shall be in the1 19hands of the treasurer at any one timenot less than twenty 1 20 thousand dollars.All such bondsThe bond shall be continued 1 21to the faithful discharge ofuntil the treasurer faithfully 1 22 discharges the duties of the officeof treasurer. Theamount1 23andsufficiency ofall bondsthe bond shall be determined by 1 24 the county treasurer of the county of the extension district 1 25and upon the. The county treasurer's approval shall be 1 26 endorsed on the bond, which shall be filed with the county 1 27 auditor of the county of the extension districtwho. The 1 28 county auditor shall notify the chairperson of the extension 1 29 council of the approval by the county treasurer and of the 1 30 bond's filingthereofin the auditor's office. The cost of 1 31any corporatethe surety bondso furnished by a treasurer1 32 shall be paid for by the extension council. 1 33 EXPLANATION 1 34 Code section 176A.14 provides that the treasurer of the 1 35 extension council must execute a corporate surety bond to the 2 1 extension district before assuming the duties of office. 2 2 Current law provides that the amount of the bond is 125 2 3 percent of the amount estimated to be in the custody of the 2 4 treasurer at any one time. This bill strikes that requirement 2 5 and provides that the amount of the bond must be not less than 2 6 $20,000. The bill also makes nonsubstantive changes in the 2 7 section in order to enhance the section's readability. 2 8 LSB 2387SS 77 2 9 da/jj/8
