1 1 Section 1. NEW SECTION. 314.28 BARRIERS REQUIRED AT
1 2 CONSTRUCTION SITES.
1 3 The department shall provide or require a contractor
1 4 performing highway maintenance or construction to provide a
1 5 moveable barrier in the lane of a highway which is closed and
1 6 undergoing maintenance or construction. The barrier shall be
1 7 placed no closer than one hundred yards from the highway
1 8 maintenance or construction workers and no farther than five
1 9 hundred yards from the workers. The barrier shall be of
1 10 sufficient size and weight to bring a motor vehicle of any
1 11 size and weight which collides with the barrier to a stop
1 12 within one hundred yards. The distance between the barrier
1 13 and the end of the highway maintenance or construction zone
1 14 shall be clearly marked to indicate that traffic is prohibited
1 15 from entering the lane in which the barrier is located.
1 16 EXPLANATION
1 17 This bill requires the department of transportation to
1 18 utilize, and to require contractors to utilize, a moveable
1 19 barrier in the lane of a highway which is closed and
1 20 undergoing maintenance or construction. The barrier must be
1 21 capable of stopping any motor vehicle within 100 yards and
1 22 must be located between 100 and 500 yards from the workers
1 23 performing the maintenance or construction.
