1 4 RELATING TO NONOCCUPATIONAL HEALTH CARE PLAN PAYMENTS WHEN
1 5 AN EMPLOYER DISPUTES WORKERS' COMPENSATION LIABILITY.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 85.38, subsection 2, Code 1997, is
1 10 amended by adding the following new unnumbered paragraph:
1 11 NEW UNNUMBERED PARAGRAPH. If an employer denies liability
1 12 under this chapter, chapter 85A, or chapter 85B, for payment
1 13 for any medical services received by an employee with a
1 14 disability, and the employee is a beneficiary under either an
1 15 individual or group plan for nonoccupational illness, injury,
1 16 or disability, the nonoccupational plan shall not deny payment
1 17 for the medical services received on the basis that the
1 18 employer's liability for the medical services under this
1 19 chapter, chapter 85A, or chapter 85B is unresolved.
