PAG LIN 1 1 SENATE FILE 161 1 2 1 3 AN ACT 1 4 MODIFYING THE HOLDING TEMPERATURE REQUIRED FOR THE STORAGE 1 5 OF EGGS SOLD AT RETAIL. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 196.8, Code 1997, is amended read as 1 10 follows: 1 11 196.8 QUALITY. 1 12 1. All eggs offered for sale to an establishment must be 1 13 no lower than United States department of agriculture consumer 1 14 grade "B".Retailers selling eggs at retail must hold eggs at1 15a temperature not to exceed sixty degrees Fahrenheit or1 16sixteen degrees Celsius.From the time of candling and 1 17 grading until they reach the consumer, all eggs designated for 1 18 human consumption shall be held at a temperature not to exceed 1 19 forty-five degrees Fahrenheit or seven degrees Celsius ambient 1 20 temperature. The forty-five degrees Fahrenheit or seven 1 21 degrees Celsius ambient temperature requirement applies to any 1 22 place or room in which eggs are stored, except inside a 1 23 vehicle during transportation where the ambient temperature 1 24 may exceed forty-five degrees Fahrenheit or seven degrees 1 25 Celsius, provided the transport vehicle is equipped with 1 26 refrigeration units capable of delivering air at a temperature 1 27 not greater than forty-five degrees Fahrenheit or seven 1 28 degrees Celsius and capable of cooling the vehicle to a 1 29 temperature not greater than forty-five degrees Fahrenheit or 1 30 seven degrees Celsius. All shell eggs shall be kept from 1 31 freezing. 1 32 2. Notwithstanding subsection 1, eggs gathered for sale at 1 33 a poultry show from fowl exhibited at the show which show has 1 34 received financial assistance from the state in prior fiscal 1 35 years, shall be exempt from the storage temperature and 2 1 consumer grade quality requirements contained in subsection 1. 2 2 If eggs are offered for sale at such an exhibit, five hundred 2 3 dollars is appropriated to the department to reimburse the 2 4 sponsoring agency of the exhibit for the expenses associated 2 5 with the exhibit. 2 6 2 7 2 8 2 9 MARY E.
