  1  4 ALLOWING A SUPERVISED, CONTROLLED BURN FOR WHICH A PERMIT
  1  5    HAS BEEN ISSUED DURING AN OPEN BURNING BAN.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  9    Section 1.  Section 100.40, subsection 3, Code 1997, is
  1 10 amended to read as follows:
  1 11    3.  This section does not give A proclamation issued by the
  1 12 state fire marshal the authority to prohibit pursuant to this
  1 13 section shall not prohibit a supervised, controlled burn for
  1 14 which a permit has been issued by the fire chief of the fire
  1 15 district where the burn will take place, the use of outdoor
  1 16 fireplaces, barbeque barbecue grills, properly supervised
  1 17 dumping grounds landfills, or the burning of trash in
  1 18 incinerators or trash burners made of metal, concrete,
  1 19 masonry, or heavy one-inch wire mesh, with no openings greater
  1 20 than one square inch.
