PAG LIN 1 1 Section 1. Section 321.179, subsection 1, unnumbered 1 2 paragraph 1, Code 1997, is amended to read as follows: 1 3 Notwithstanding the provisions of this chapter or chapter 1 4 321L which grant sole authority to the department for the 1 5 issuance of motor vehicle licenses, nonoperator's 1 6 identification cards, and handicappedidentification devices1 7 parking permits,thecountiesof Adams, Cass, Fremont, Mills,1 8Montgomery, and Pageshall be authorized to issue motor 1 9 vehicle licenses, nonoperator's identification cards, and 1 10 handicapped identification devices on a permanent basis. 1 11 However, a county shall only be authorized to issue commercial 1 12 driver's licenses if certified to do so by the department. If 1 13 a county fails to meet the standards for certification under 1 14 this section, the department itself shall provide for the 1 15 issuance of commercial driver's licenses in that county. The 1 16departmentshall certify the county treasurers in the 1 17permanentcounties to issue commercial driver's licenses if 1 18 all of the following conditions are met: 1 19 Sec. 2. Section 321.179, Code 1997, is amended by adding 1 20 the following new subsection: 1 21 NEW SUBSECTION. 3. Notwithstanding any other provisions 1 22 of the Code to the contrary, a county treasurer in a county 1 23 issuing motor vehicle licenses may retain for deposit in the 1 24 county general fund five dollars of the fee for each motor 1 25 vehicle license transaction, including, but not limited to, 1 26 issuance or renewal of motor vehicle licenses or nonoperator's 1 27 identification cards. 1 28 EXPLANATION 1 29 This bill removes the limitation on the number of counties 1 30 which may issue motor vehicle licenses and expands the 1 31 opportunity to do so to all counties in the state. Currently, 1 32 only Adams, Cass, Fremont, Mills, Montgomery, and Page 1 33 counties may issue motor vehicle licenses. The bill also 1 34 provides that the counties may retain $5 of the fee collected 1 35 for each motor vehicle license transaction for deposit in the 2 1 general fund of the county. 2 2 LSB 1641SS 77 2 3 mk/cf/24
