1 1 Section 1. NEW SECTION. 537A.10 WARRANTY PROVISIONS
1 2 VOID.
1 3 A provision in any contract or agreement which provides
1 4 that a warranty on any product or goods sold or delivered for
1 5 sale in this state expires or is terminated as a result of the
1 6 sale of the product or goods by the original purchaser to whom
1 7 the warranty was given is void and shall not be enforced in
1 8 this state against a subsequent purchaser of the product or
1 9 goods.
1 10 Sec. 2. NEW SECTION. 554.2318A WARRANTY PROVISIONS VOID.
1 11 Notwithstanding any other provisions of this chapter, a
1 12 provision in any contract or agreement which provides that a
1 13 warranty on any goods sold or delivered for sale in this state
1 14 expires or is terminated as a result of the sale of the goods
1 15 by the original buyer to whom the warranty was given is void
1 16 and shall not be enforced in this state against a subsequent
1 17 buyer of such goods.
1 18 EXPLANATION
1 19 This bill amends a general chapter regarding contracts and
1 20 the uniform commercial code by providing that a provision in a
1 21 contract or agreement which provides that a warranty on the
1 22 product or goods to which the contract relates expires or is
1 23 terminated upon the sale of the product or goods to a
1 24 subsequent purchaser is void and unenforceable.
