1 1 Section 1. Section 8D.2, subsection 5, Code 1997, is
1 2 amended to read as follows:
1 3 5. "Public agency" means a state agency, an institution
1 4 under the control of the board of regents, the judicial
1 5 department as provided in section 8D.13, subsection 17, a
1 6 school corporation, a city library, a regional library as
1 7 provided in chapter 256, a county library as provided in
1 8 chapter 336, a city, a county, or a judicial district
1 9 department of correctional services established in section
1 10 905.2, to the extent provided in section 8D.13, subsection 15,
1 11 an agency of the federal government, or a United States post
1 12 office which receives a federal grant for pilot and
1 13 demonstration projects.
1 14 Sec. 2. Section 8D.11, subsection 4, Code 1997, is amended
1 15 to read as follows:
1 16 4. A political subdivision receiving communications
1 17 services from the state as of April 1, 1986, may continue to
1 18 do so but communications services shall not be provided or
1 19 resold to additional political subdivisions other than a city,
1 20 a county, a school corporation, a city library, a regional
1 21 library as provided in chapter 256, and a county library as
1 22 provided in chapter 336. The rates charged to the political
1 23 subdivision shall be the same as the rates charged to state
1 24 agencies.
1 25 Sec. 3. Section 8D.13, Code 1997, is amended by adding the
1 26 following new subsection:
1 27 NEW SUBSECTION. 20. Access to the network shall be
1 28 offered to cities and counties. A city or county shall be
1 29 responsible for all costs associated with becoming a part of
1 30 the network.
1 31 Sec. 4. This Act, being deemed of immediate importance,
1 32 takes effect upon enactment.
1 33 EXPLANATION
1 34 This bill defines cities and counties as public agencies
1 35 for purposes of the Iowa communications network. Access to
2 1 the network is to be offered to cities and counties so long as
2 2 a city or county pays for all costs associated with becoming a
2 3 part of the network.
2 4 This bill would take effect upon enactment.
