  1 26 Out-of-state teachers may be charged tuition for the
  1 27 training.  However, reading recovery training shall be
  1 28 limited to participation by teachers employed by
  1 29 school districts or accredited nonpublic schools in
  1 30 Iowa unless training capacity exceeds the number of
  1 31 teachers employed by school districts or accredited
  1 32 nonpublic schools in Iowa who are willing and able to
  1 33 participate in the program.  The department shall make
  1 34 every".

  1 46    "Sec. ___.  Section 257.6, subsection 1, Code 1997,
  1 47 is amended by adding the following new unnumbered
  1 48 paragraph:
  1 49    NEW UNNUMBERED PARAGRAPH.  A child who is not a
  1 50 resident of Iowa shall be considered a resident pupil
  2  1 for purposes of paragraph "a" if the child's parent or
  2  2 legal guardian is a resident of a contiguous state and
  2  3 is employed as a teacher in an Iowa school district
  2  4 with an enrollment of fewer than four hundred pupils
  2  5 and that borders two other states, if the contiguous
  2  6 state statutorily authorizes reciprocity in
  2  7 substantial accord with this section, and if the board
  2  8 of directors of the school district approves the
  2  9 enrollment of the child in the school district."
  2 10    #15.  Page 27, by inserting after line 9 the
  2 11 following:
  2 12    "Sec. ___.  Section 260C.15, subsection 1, Code
  2 13 1997, is amended to read as follows:
  2 14    1.  Regular elections held annually by the merged
  2 15 area for the election of members of the board of
  2 16 directors as required by section 260C.11, for the
  2 17 renewal of the twenty and one-fourth twenty-seven
  2 18 cents per thousand dollars of assessed valuation levy
  2 19 authorized in section 260C.22, or for any other matter
  2 20 authorized by law and designated for election by the
  2 21 board of directors of the merged area, shall be held
  2 22 on the date of the school election as fixed by section
  2 23 277.1.  The election notice shall be made a part of
  2 24 the local school election notice published as provided
  2 25 in section 49.53 in each local school district where
  2 26 voting is to occur in the merged area election and the
  2 27 election shall be conducted by the county commissioner
  2 28 of elections pursuant to chapters 39 to 53 and section
  2 29 277.20."
  2 30    #16.  Page 27, by inserting after line 9 the
  2 31 following:
  2 32    "Sec. ___.  Section 260C.17, Code 1997, is amended
  2 33 to read as follows:
  2 34    260C.17  PREPARATION AND APPROVAL OF BUDGET – TAX.
  2 35    The board of directors of each merged area shall
  2 36 prepare an annual budget designating the proposed
  2 37 expenditures for operation of the community college.
  2 38 The board shall further designate the amounts which
  2 39 are to be raised by local taxation and the amounts
  2 40 which are to be raised by other sources of revenue for
  2 41 the operation.  The budget of each merged area shall
  2 42 be submitted to the state board no later than May 1
  2 43 preceding the next fiscal year for approval.  The
  2 44 state board shall review the proposed budget and
  2 45 shall, prior to June 1, either grant its approval or
  2 46 return the budget without approval with the comments
  2 47 of the state board attached to it.  Any unapproved
  2 48 budget shall be resubmitted to the state board for
  2 49 final approval.  Upon approval of the budget by the
  2 50 state board, the board of directors shall certify the
  3  1 amount to the respective county auditors and the
  3  2 boards of supervisors annually shall levy a tax of
  3  3 twenty and one-fourth twenty-seven cents per thousand
  3  4 dollars of assessed value on taxable property in a
  3  5 merged area for the operation of a community college.
  3  6 Taxes collected pursuant to the levy shall be paid by
  3  7 the respective county treasurers to the treasurer of
  3  8 the merged area as provided in section 331.552,
  3  9 subsection 29.
  3 10    It is the policy of this state that the property
  3 11 tax for the operation of community colleges shall not
  3 12 in any event exceed twenty and one-fourth twenty-seven
  3 13 cents per thousand dollars of assessed value, and that
  3 14 the present and future costs of such operation in
  3 15 excess of the funds raised by such levy shall be the
  3 16 responsibility of the state and shall not be paid from
  3 17 property tax."
  3 18    #17.  Page 27, by inserting before line 10 the
  3 19 following:
  3 20    "Sec. ___.  Section 260C.22, subsection 1,
  3 21 paragraph a, Code 1997, is amended to read as follows:
  3 22    a.  In addition to the tax authorized under section
  3 23 260C.17, the voters in any merged area may at the
  3 24 annual school election vote a tax not exceeding twenty
  3 25 and one-fourth twenty-seven cents per thousand dollars
  3 26 of assessed value in any one year for a period not to
  3 27 exceed ten years for the purchase of grounds,
  3 28 construction of buildings, payment of debts contracted
  3 29 for the construction of buildings, purchase of
  3 30 buildings and equipment for buildings, and the
  3 31 acquisition of libraries, for the purpose of paying
  3 32 costs of utilities, and for the purpose of
  3 33 maintaining, remodeling, improving, or expanding the
  3 34 community college of the merged area.  If the tax levy
  3 35 is approved under this section, the costs of utilities
  3 36 shall be paid from the proceeds of the levy.  The tax
  3 37 shall be collected by the county treasurers and
  3 38 remitted to the treasurer of the merged area as
  3 39 provided in section 331.552, subsection 29.  The
  3 40 proceeds of the tax shall be deposited in a separate
  3 41 and distinct fund to be known as the voted tax fund,
  3 42 to be paid out upon warrants drawn by the president
  3 43 and secretary of the board of directors of the merged
  3 44 area district for the payment of costs incurred in
  3 45 providing the school facilities for which the tax was
  3 46 voted."
  3 47    #18.  By striking page 29, line 25, through page
  3 48 30, line 6.
  3 49    #19.  Page 31, by striking line 17 and inserting
  3 50 the following:  "1997, is amended by striking the
  4  1 subsection and inserting in lieu thereof the
  4  2 following:
  4  3    9.  For the fiscal year beginning July 1, 1998, and
  4  4 for each succeeding fiscal year, the amount of fifty
  4  5 thousand dollars to the department of education for
  4  6 the Iowa mathematics and science coalition from phase
  4  7 III moneys."
  4  8    #20.  Page 36, by striking lines 33 and 34 and
  4  9 inserting the following:  "information services for
  4 10 purposes of the open access program, being deemed of".
