  2 28 to a residential program under the provisions of a
  2 29 medical assistance home and community-based services
  2 30 waiver for persons with mental retardation, provided
  2 31 the adult residential environments meet all of the
  2 32 following requirements:
  2 33    a.  The intermediate or residential care facility
  2 34 for persons with mental retardation license is
  2 35 surrendered.
  2 36    b.  The environment's bed capacity is reduced by at
  2 37 least twenty-five percent to a maximum capacity of no
  2 38 more than twelve beds.
  2 39    c.  The environment submits a five-year plan for
  2 40 further bed capacity reduction to the department of
  2 41 human services and the plan is acceptable to the
  2 42 department of human services.
  2 43    The director of human services may authorize
  2 44 reimbursement of the costs of environments converted
  2 45 in accordance with this subsection from moneys
  2 46 appropriated for state supplementary assistance at a
  2 47 rate which does not exceed the maximum allowed for a
  2 48 residential program under state supplementary
  2 49 assistance requirements.  The departments of human
  2 50 services and inspections and appeals shall develop
  3  1 standards and a monitoring process for environments
  3  2 converted under this subsection.  If the provisions of
  3  3 this subsection are implemented, the department of
  3  4 human services shall submit amendments to the general
  3  5 assembly in accordance with section 2.16 to codify the
  3  6 provisions."

  3  9 consultation with the board established for the child
  3 10 health care program, shall develop and utilize an
  3 11 application form, which does not exceed two pages in

  3 50 implementation of the single point of access program."

  4  6    "b.  (1)  If at any time after September 30, 1998,
  4  7 annualization of a region's current expenditures
  4  8 indicates a region is at risk of exceeding its group
  4  9 foster care expenditure target under section 232.143
  4 10 by more than five percent, the department and juvenile
  4 11 court services shall examine all group foster care
  4 12 placements in that region in order to identify those
  4 13 which might be appropriate for termination.  In
  4 14 addition, any aftercare services believed to be needed
  4 15 for the children whose placements may be terminated
  4 16 shall be identified.  The department and juvenile
  4 17 court services shall initiate action to set
  4 18 dispositional review hearings for the placements
  4 19 identified.  In such a dispositional review hearing,
  4 20 the juvenile court shall determine whether needed
  4 21 aftercare services are available and whether
  4 22 termination of the placement is in the best interest
  4 23 of the child and the community.
  4 24    (2)  The department shall provide quarterly reports
  4 25 to the judicial department, juvenile court services,
  4 26 the legislative fiscal bureau, and decategorization
  4 27 boards on the number of children placed in group
  4 28 foster care and the amount of expenditure for group
  4 29 foster care by county.  The department shall
  4 30 coordinate with the child welfare services work group
  4 31 created in November 1997, by the legislative council
  4 32 and with interested decategorization counties to
  4 33 identify information systems and reports across all
  4 34 services and placements that would support utilization
  4 35 management decisions.  The department shall identify
  4 36 the resources needed to develop and implement such a
  4 37 system and its fiscal benefits, and report to the
  4 38 general assembly by February 1, 1999."
  4 39    #27.  Page 32, by inserting after line 21 the
  4 40 following:
  4 41    "___.  The department shall perform an evaluation
  4 42 of public and private residential treatment programs,
  4 43 including those programs providing highly structured
  4 44 juvenile program beds.  The evaluation shall include
  4 45 but is not limited to a review of the curriculum and
  4 46 treatment approaches used by the programs, the
  4 47 recidivism rate of juveniles who have completed the
  4 48 programs, and other selected variables, subject to the
  4 49 availability of this information.  A report of the
  4 50 evaluation shall be submitted to the general assembly
  5  1 by January 1, 1999."

  5 20 association of counties in reviewing the reimbursement
  5 21 methodology provided in this lettered paragraph to
  5 22 determine whether modifications in the methodology or
  5 23 implementation of an alternate methodology are
  5 24 appropriate.  The department shall report on the
  5 25 review in December 1998 to the persons required by
  5 26 this Act for submission of reports."
  5 27    #32.  Page 44, by inserting after line 2 the

  5 29    "4.  For the fiscal year beginning July 1, 1998, in
  5 30 addition to the net budgeting requirements under this
  5 31 section, each state mental health institute shall
  5 32 implement a net budgeting accounting test of managing
  5 33 revenues and expenditures attributable to the mental
  5 34 health institute in a manner that permits the net
  5 35 state expenditure amount to be determined.  Each
  5 36 mental health institute shall submit a preliminary
  5 37 report in January 1999, and a status report in October
  5 38 1999, to the governor and to the persons required to
  5 39 be submitted reports by this Act.  The preliminary and
  5 40 status reports shall identify advantages and
  5 41 disadvantages of utilizing the net budgeting approach
  5 42 and any changes in policy or statute recommended to
  5 43 improve implementation of the approach."

  6 44 activities for additional fraud and recoupment
  6 45 activities performed by the department of human
  6 46 services or the department of inspections and appeals,

  6 48    1.  The director of human services or the director
  6 49 of inspections and appeals determines that the
  6 50 investment can reasonably be expected to increase
  7  1 recovery of assistance paid in error, due to
  7  2 fraudulent or nonfraudulent actions, in excess of the
  7  3 amount recovered in the fiscal year beginning July 1,
  7  4 1997.
  7  5    2.  The amount expended for the additional fraud
  7  6 and recoupment activities shall not exceed the amount
  7  7 of the projected increase in assistance recovered."
  7  8    #44.  Page 66, by inserting after line 27 the
  7  9 following:
  7 10    "Sec. ___.  MEDICAL AND SURGICAL TREATMENT OF
  7 11 INDIGENT PERSONS – STUDY.  The legislative council is
  7 12 requested to establish a 1998 legislative interim
  7 13 committee to review the medical and surgical treatment
  7 14 of indigent persons in the state through the
  7 15 university of Iowa hospitals and clinics under chapter
  7 16 255 and 255A.  The review should include but is not
  7 17 limited to the programs and services provided and the
  7 18 possibility of providing these programs and services
  7 19 at alternative locations throughout the state."
  7 20    #45.  Page 66, by inserting after line 27, the
  7 21 following:
  7 22    "Sec. ___.  HAWK-I TRUST FUND.
  7 23    1.  If House File 2517 is enacted by the Seventy-
  7 24 seventh General Assembly, 1998 Session, a HAWK-I trust
  7 25 fund is created in the state treasury under the
  7 26 authority of the department of human services, to
  7 27 which all state appropriations shall be deposited and
  7 28 used to carry out the purposes of this chapter.  Other
  7 29 revenues of the program such as grants, contributions,
  7 30 and participant payments shall not be considered
  7 31 revenue of the state, but rather shall be funds of the
  7 32 program.
  7 33    2.  The trust fund shall be separate from the
  7 34 general fund of the state and shall not be considered
  7 35 part of the general fund of the state.  The moneys in
  7 36 the trust fund are not subject to section 8.33 and
  7 37 shall not be transferred, used, obligated,
  7 38 appropriated, or otherwise encumbered except as
  7 39 provided in this chapter.  Notwithstanding section
  7 40 12C.7, subsection 2, interest or earnings on moneys
  7 41 deposited in the trust fund shall be credited to the
  7 42 trust fund."
