1 4 ESTABLISHING AN ELECTRONIC BENEFITS TRANSFER PROGRAM IN THE
1 5 DEPARTMENT OF HUMAN SERVICES.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. NEW SECTION. 234.12A ELECTRONIC BENEFITS
1 10 TRANSFER PROGRAM.
1 11 1. The department of human services may establish an
1 12 electronic benefits transfer program utilizing electronic
1 13 funds transfer systems. The program, if established, shall at
1 14 a minimum provide for all of the following:
1 15 a. A retailer shall not be required to make cash
1 16 disbursements or to provide, purchase, or upgrade electronic
1 17 funds transfer system equipment as a condition of
1 18 participation in the program.
1 19 b. A retailer providing electronic funds transfer system
1 20 equipment for transactions pursuant to the program shall be
1 21 reimbursed fifteen cents for each approved transaction
1 22 pursuant to the program utilizing the retailer's equipment.
1 23 c. A retailer that provides electronic funds transfer
1 24 system equipment for transactions pursuant to the program and
1 25 who makes cash disbursements pursuant to the program utilizing
1 26 the retailer's equipment shall be paid a fee of fifteen cents
1 27 by the department for each cash disbursement transaction by
1 28 the retailer.
1 29 2. A point-of-sale terminal which is used only for
1 30 purchases from a retailer by electronic benefits transfer
1 31 utilizing electronic funds transfer systems is not a satellite
1 32 terminal as defined in section 527.2.
