  1  1    Amend the amendment, S-5543, to House File 2494, as
  1  2 amended, passed, and reprinted by the House, as
  1  3 follows:
  1  4    #1.  Page 9, by inserting after line 9 the
  1  5 following:
  1  6    "NEW SUBSECTION.  5A.  "Cemetery" means a space
  1  7 held for the purpose of permanent burial, entombment,
  1  8 or interment of human remains that is owned or managed
  1  9 by a political subdivision or private entity, or a
  1 10 cemetery regulated pursuant to chapter 523I or 566A.
  1 11 However, "cemetery" does not include a pioneer
  1 12 cemetery as defined in section 331.325."
  1 13    #2.  Page 9, by inserting after line 15 the
  1 14 following:
  1 15    "Sec. 101.  Section 455B.161, subsection 17, Code
  1 16 1997, is amended to read as follows:
  1 17    17.  "Public use area" means that any of the
  1 18 following:
  1 19    a.  A portion of land owned by the United States,
  1 20 the state, or a political subdivision with facilities
  1 21 which attract the public to congregate and remain in
  1 22 the area for significant periods of time, as provided
  1 23 by rules which shall be adopted by the department
  1 24 pursuant to chapter 17A.
  1 25    b.  A cemetery."
  1 26    #3.  Page 17, by inserting after line 25 the
  1 27 following:
  1 28    "NEW SUBSECTION.  7.  The distance between an
  1 29 animal feeding operation structure and a cemetery, if
  1 30 any of the following applies:
  1 31    a.  The animal feeding operation structure was
  1 32 constructed or expanded prior to the effective date of
  1 33 this section of this Act.
  1 34    b.  The construction or expansion of the animal
  1 35 feeding operation structure began prior to the
  1 36 effective date of this section of this Act."
