1 2 as amended, passed, and reprinted by the Senate, as

1 4 #1. Page 1, by inserting before line 6 the
1 5 following:
1 6 "# . Page 1, by inserting after line 10 the
1 7 following:
1 8 "Sec. 1000. Section 321.12, Code Supplement 1997,
1 9 is amended by adding the following new subsection:
1 10 NEW SUBSECTION. 5. Notwithstanding subsection 4
1 11 and section 321J.2, subsection 4, paragraph "a", the
1 12 twelve-year time frame for determining whether an
1 13 offense is a first, second, or subsequent violation
1 14 under chapter 321J shall apply prospectively from July
1 15 1, 1997, in the following manner:
1 16 The first offense by a person under chapter 321J
1 17 committed on or after July 1, 1997, shall be
1 18 considered the person's first offense within the
1 19 twelve-year calculation period, regardless of any
1 20 offenses committed prior to July 1, 1997, whether or
1 21 not such offenses are reflected on the person's
1 22 operating records.""
1 23 #2. Page 13, by inserting before line 11 the
1 24 following:
1 25 "Sec. ____. RETROACTIVE APPLICABILITY. Section
1 26 1000 of this Act is retroactively applicable to July
1 27 1, 1997, and is applicable on and after that date."
