  1  1    Amend Senate File 2410 as follows:
  1  2    #1.  Page 35, by inserting after line 16 the
  1  3 following:
  1  4    "18.  a.  It is the intent of the general assembly
  1  5 that the department of human services work with the
  1  6 child welfare services work group created by the
  1  7 legislative council in November 1997 to pursue
  1  8 initiatives to increase receipt of funding under Title
  1  9 IV-E of the federal Social Security Act.  For the
  1 10 fiscal year beginning July 1, 1998, the department may
  1 11 expend moneys, not to exceed $20,000, within the
  1 12 department's budget to contract for consultant
  1 13 services to increase this funding.
  1 14    b.  If additional funding is received under Title
  1 15 IV-E of the federal Social Security Act as a result of
  1 16 administrative activities performed by juvenile court
  1 17 services or community providers, the funding shall be
  1 18 expended as follows:
  1 19    (1)  A portion shall be used by the department to
  1 20 provide technical assistance and to monitor claims
  1 21 submitted by juvenile court services and community
  1 22 providers to ensure that the claims meet federal
  1 23 requirements.
  1 24    (2)  A portion shall be distributed to providers
  1 25 with increased costs incurred from activities to draw
  1 26 the additional funding.
  1 27    (3)  A portion shall be made available to
  1 28 decategorization projects in which additional funding
  1 29 is drawn to be used to pay for activities based on
  1 30 local needs, as determined by the decategorization
  1 31 projects.
  1 32    c.  Any additional funding received under Title IV-
  1 33 E of the federal Social Security Act for field
  1 34 operations or general administration that is not used
  1 35 for field operations or general administration
  1 36 expenditures, shall be transferred for funding of
  1 37 activities under the appropriations in this Act in
  1 38 this section and for court-ordered services provided
  1 39 to juveniles."
  1 40    #2.  Page 38, by inserting after line 35 the
  1 41 following:
  1 42    "___.  Federal funding received by the state during
  1 43 the fiscal year beginning July 1, 1998, as the result
  1 44 of the expenditure of state funds appropriated during
  1 45 a previous state fiscal year for a service or activity
  1 46 funded under this section, shall be used as additional
  1 47 funding for services provided under this section.
  1 48 Moneys received by the department in accordance with
  1 49 the provisions of this subsection shall remain
  1 50 available for the purposes designated until June 30,
  2  1 2000."
  2  2    #3.  Page 41, by striking lines 10 through 14 and
  2  3 inserting the following:
  2  4    "(b)  If an individual is committed to the custody
  2  5 of the department of corrections at the time the
  2  6 individual is referred for dual diagnosis treatment,
  2  7 the department of corrections shall be charged for the
  2  8 costs of treatment."
  2  9    #4.  Page 41, line 20, by inserting after the word
  2 10 "in" the following:  "and authorized by or decertified
  2 11 by".
  2 12    #5.  Page 63, by inserting after line 13 the
  2 13 following:
  2 14    "Sec. ___.  SEXUALLY VIOLENT PREDATORS.  The
  2 15 department of human services and the department of
  2 16 corrections shall work with the office of the attorney
  2 17 general in jointly establishing a task force for
  2 18 identifying the population of persons deemed to be
  2 19 sexually violent predators and to develop options
  2 20 appropriate for addressing public safety concerns
  2 21 associated with this population.  The task force may
  2 22 consult with qualified mental health professionals,
  2 23 corrections professionals, prosecutors, and others
  2 24 experienced in the assessment and treatment of this
  2 25 population.  The task force shall consider currently
  2 26 available treatment options, the prevalence of
  2 27 subpopulations which present a high risk of
  2 28 reoffending upon release, and the percentage of the
  2 29 existing criminal sex offender population which is not
  2 30 amenable to treatment under currently known methods.
  2 31 The task force shall identify any treatment methods
  2 32 known to have success in treating this population and
  2 33 subpopulations as well as the costs associated with
  2 34 those methods, develop a proposal for state-of-the-art
  2 35 treatment of sexually violent predators, and develop a
  2 36 plan describing possible use of treatment resources
  2 37 together with options for intensive monitoring upon
  2 38 release.  The task force report shall be submitted on
  2 39 or before January 1, 1999, to the members of the joint
  2 40 appropriations subcommittees on human services and on
  2 41 the justice system."
